By the way, I'm also talking about third party liabilty din. Hindi lang banga sa ibang kotse kungdi pati kung makabangga ka ng tao. Sigurado hahanapan ka ng pulis kung ikaw talaga ang may-ari ng kotse. Kawawa naman yung may-ari ng dating kotse mo kasi sigurado iyon ang hu-huntingin ng mga police. :D

as a seller, i always require a deed of sale and transfer of ownership prior to releasing the vehicle. mahirap na kung may mangyari, madamay ka sa kasalanan ng new owner. yung sa pajero ko, i took care of it all for a minimum fee of P5000 (kumita pa ako dahil P4000 lang nagastos ng fixer ko)

pwede ka na kumuha ng clearance sa local TMG or Highway Patrol office dyan sa lugar nyo.. sila na magve-verify sa main office yun nga lang hintay ka mga 3 days..

kailangan ng original OR/CR sa paglipat ng ownership, diba naiiwan ito sa creditor mo at ibibigay lang kung fully paid na.

Then kung banko pa ang creditor mo ipapa kansel mo pa muna ang chattel mortgage bago mo mailipat.

Here are my thoughts if I am following this thread corrrectly. Sold my car last with balance with the bank that the buyer assumed. Bank (BPI) allowed us and they even prepared a deed of sale with assumption of mortgage to clear me of any obligations. The objective here is to avoid being chased by the bank if the buyer defauls from payment. Next thing that I did was contact my insurance broker and faxed to him the deed of sale so he may endorse the policy to the new owner. This early, BPI will transfer the LTO docs under the buyer's name name after we have submitted the stencil of the vehicle. Hope this helps.

gumamit lang kami ng ibang tao/name (family friend namin)..kasi paalis ako

non kaya wla time mag ayos ng papers pa at saka hinabol lang namin ang

sales promo that time (laki din na menos naman sa promo).

since ang friend namin naka ilan purchase na ng unit ..sumabay kami at doon

nakalagay name niya ..pero never niya ginamit or inuuwi sa kanila ang

vehicle...name lang talaga pero ako nag babayad monthly(bait nga buti d

tinakbo or kunin wla ako magagawa kasi sana name nya talaga)..ngayon plan

na namin sana ilipat.ng ownership sabay ko na sa pag rehistro..eh kaso

mauuna matapos ang registration kaysa sa payment ..

kaya ganon ang Question ko kung pwede change ownership b4

kapag sa banko ,yung cr mo me malaking nakalagay sa cr na ENCUMBERED,hindi mo maiibenta o ma change of ownership ang cr , para ma change, you need the release chattel mortgage from the bank .

My car has been fully paid in the bank. Chattel Mortgage cancellation is also released by the bank. Unfortunately the CR got lost, we secured a new copy from LTO pero meron pa ring encumbered na nakalagay sa CR na bago, nakatype dun sa upper left corner field ng form. Talaga bang ganun?

when you had the new C.R. made, you should have attached the release from the bank, then they would have used a clean C/R. and not an encumbered one.
