    In some cases of sales of property made by a developer, some contract provisions which continue to be in force are those which require the purchaser to abide by the terms and conditions of the Master Deed, the Rules and Regulations promulgated by the Homeowner's Association, etc.

    The turnover of the common areas of the subdivision to the Homeowner's Association usually happens when the subdivision project has been fully sold. This is per the HLURB.

    The Developer can reserve the right to appoint the directors or officers of the association for a specific number of years to ensure control of the maintenance over the common areas of your subdivision. Of course, this is not a hard and fast rule. Check the articles of incorporation and by-laws of your association.

    Yes, as a homeowner (or lot owner) of the subdivision, you automatically become a member of the association and are subject to its rules and regulations, including the payment of association dues. This is ordinarily stated in the Master Deed and annotated at the back of your TCT.

    Wala naman problema yun, so long as the basic services required (i.e. maintenance of common areas, trash disposal, security) are being provided by the association. Ang masama siguro kapag kolekta lang ang association tapos wala naman services provided. The association should be transparent at all times regarding its finances and any homeowner will have the right to inspect its financial records.
