    nakakainis naman talaga yung mga taga NTC na nag dedelehensya. I used to be active in amateur radio before the we had cellphones and noon medyo masaya pa since ang lalakas ng mga radyo before. Imagine on a clear sunday minsan nakakausap ko pa yung mga friends ko sa UPLB kahit nandito ako sa UP Diliman. As for the talkabout medyo ang nahihinaan ako kasi sa mall ang hirap magkaintindihan like in megamall ang dami kasi obstructions.


    sa hina nung mga units na yan dapat wala na licence kasi wala naman sila talagang macacause na interference eh.

    BTW bat yung walkie talkie ng mga bata di pinagbabawal?

    I checked with NTC ... meron ngang registration at pwede daw nila huliin yung unit pero they have to issue you a receipt so you can claim it at their office at a fee. Make sure you get a receipt for claiming it para kung kulang ang nasa resibo ... may evidence ka for your media exposure. Greet mo nalang ako on air.

    the legal basis that NTC uses to justify its regulation of FRS radios is their authority to regulate the radio spectrum allocation. this is found under Republic Act 3846 as amended by EO 546, Republic Act No. 7925 and Sec 600(a) of the IRR of RA 7925. In addition, the radio spectrum allocation is also found in Memorandum Circular 3-3-96 and 2-4-90 issued by the NTC. however, in the aforementioned laws and circulars, there is no direct mention of FRS or personal radio service.

    the closest justification with respect to FRS or PRS is Office Order No 58-89 which mentions PRS in connection with decentralized licensing of personal radio service

    however, this office order does not define PRS.

    so where does this leaves us, the consumers? for one, the NTC has not defined FRS properly. Neither has it defined personal radio service.

    what about toy walkie talkies? are they going to require licenses for this also? what if you argue that the FRS you have is a toy?

    i also have an FRS and if i meet an NTC guy who wishes to confiscate this, i will first of all tell him to show me his authority to do so (the Philippine constitution prohibits search and seizures without a proper warrant) and secondly, i will tell him to show me the law defining that what i have is a personal radio service as defined in Office Order 58-89.

    check his reaction at mamumula yan kasi pati ntc wala pang batas nyan, AFAIK.

    otherwise, if he insists, then get his name and tell him that you reserve the right to file a suit against him for all the inconvenience you are being made to experience.

    while i do not condone defying the law since we should not. HOWEVER, when the law is vague or ill defined, then it should not be used to abuse the consumers or the general public and if we are so abused, it is our right to object

    i agree with kimpoy that galit rin ako sa mga confiscations na yan. ano ito, martial law?????

    salamat sa info guys. kakagaling ko lang ntc, i paid 1500 for 2 units registration. nung dumating sila i think naririnig nila yung name ng store kaya inabangan na nila yung employee namin na gumamit. nung pagkapindot ayun lapit na sila. with a permit to confiscate. gusto pa nila isurender ko yung isa pero di na ako pumayag. kahapon they even warned me na kapag hindi ako sumipot magkaka violation daw ako. sobra kulit ko na insisting na frs lang ito. still they said BAWAL NGS YAN. ingat nalang peeps. ibahin niyo names niyo.

    NTC, National telecomunnications commission. I am sure the tsikoteers can think of other words that stands for NTC, like NapakaTanga't Corrupt!!
    Ganun talaga yan. We make laws whatever we please. Airwaves is the exclusive domain of the NTC. All water, whether surface or underground, is owned by the government. Eventually, the air we breathe, we will be charged for every breath we suck in.
    Yung mga icom and motorola radios namin sa office, we have slowly phased them out and shifted to cellphones. Our repeater we have junked, it is just too much to maintain, grabe na ang mga charges ng NTC, kailangan mo pa ng radio operator class c license. Yung iba, naka amateur license, pero technically, di pwede. Iba ang charge nila kung portable, iba ang base radio. Either way, one way or another, we are violating some crazy obscure law because there are just too many laws or too many loopholes. Plus all these barangay ordinances, legal sa isang barangay, paglipat mo sa kabilang barangay, bawal na. Galing ng pinoy ano?

    Teka, meron nga ba talagang Rules, Memo circular, Executive orders or ano pa man stating na yung FRS eh kailangan ng permit?

    PROMDIBOY, sana eh inalam mo na din kung anong number yung MC na yun, para alam natin, kase baka sila (NTC) mismo eh di nila alam eh.

    PROMDIBOY -- bago yan ah, i.e. a "permit to confiscate." this is the first time i have heard of such a "permit", hahahaha

    this is in the nature of a roving warrant and is not valid under our constitutional laws. syempre, how can an ntc issuance be over and above our constitution. an FRS radio is not an illegal item per se (like guns or drugs) that can be seized on sight. it is so typical of government to take advantage of this situation and bully innocent citizens! potek, kung ako yun sigurado minumura ko na yung mga ntc na yun at hinamon ko na -- sa korte ha! hehehehe

    for a warrant to be valid, the item to be seized and the persons or subjects of the search or seizure has to be specific. settled na ito in our laws

    puede ma question yung "permit to confiscate" na yan ah. baka nga xerox copy lang ito na panay na recirculate na. this happens with some arrest warrants because even an arrest warrant has a life and cannot be served unless a new one is issued

    i would be interested in seeing this so called "permit to confiscate" at mabusisi nga ng mabuti ito. if you can have a copy, paki scan nalang and send to my email address

    benderbot, wala akong copy nung permit to confiscate. pag lapit palang nila pinakita na nila agad, at nakalagay pa doon yung store name namin. kaya ibig sabihin nakikinig talaga sila. 5 sila 3 naka barong pa. talagang taga ntc sila kasi sila yung nakita ko sa office. meron na ako receipt nung permit. to follow daw yung permit to operate.
    hindi ko na pinalaki pa usapan kasi wala din ako idea kung ano dapat gawin. iniinsist ko lang na FRS lang ito. kailangan daw registered parin.
