Well naisip kona mga yan, kaso wala din naman mangyayari pag ginawa ko mga yan, kaya hayaan konalang sila kung ano gusto nilang gawin..

actually may hearing dapat kami kaninang 5pm sa barangay pero hinde ako pumunta, hinde naman tumawag yung barangay to ffup, then pag alis ko sa bahay kanina ay nakita ko yung kapatid ng kapit bahay namin na nangungupahan lang sa area namin, sama makatingin...

gusto ko sana siya lapitan para tanungin kung baket ang sama niya makatingin or pwede din lapitan ko siya tapos barilin ko gamit kamay ko..hahaha...pero hinayaan ko nalang...

Waste of time and energy..hehehe

Umattend ka lang ng barangay conciliation (kung meron pa susunod) para at least may record ng side mo.. I doubt na magdedemanda yang may ari ng Innova..

kung magdemanda man, dismissed yan kung may criminal case (baka tawanan lang ng fiscal yan) and kung may civil case, meron tinatawag na small claims cases (not exceeding 100k ang involved). summary in nature yun and walang abugado involved pero judge ang may hawak.. (susubmit kayo ng affidavit nyo dun)

ang thrust ng SC ay walang umakyat ng kaso kung makukuha sa mabuting usapan

i think the objective of the barangay meeting is to see if things can be patched up at their level.
from what i can glean, i think it is time to tell the barangay kaps that you do not think it can be settled at their level anymore.
"kita na lang tayo sa korte."
and with evidence like what they have, i doubt if the fiscal will allow the case to proceed to court.

ambilis yung kayo ang nag inquire...

natawa ako sa statement niyo na "Bulok na yung innova nya wala pang decision ang court dyan." hehehe

hinde natin alam takbo ng utak ng mga taong un, pero na blotter na namin sila sa barangay na kung may mangyari samin, pamilya ko or mga ariarian namin ay sila agad ang prime suspect, kasi sila lang ang kaalitan namin.

mga bata pa kasi mga yun, nasa age ranging from 24 to 28 siguru, kasi mukhang kakatubo lang ng mga bigote eh hehehe...hinde pa pantay ang tubo...

anyway...thank you sir again for the help...

Update mga sir, nagpadala nung lunes ng sulat si barangay for 2nd hearing pero hinde kami sumipot dahil 9am, wala na kami sa bahay nun, tapos kanina pumunta ung kaps sa bahay namin para makibalita, kasi pursigidi raw mag sampa ng kaso ung innova, sabi ko sorry kaps pero hinde na kami sisiput sa hearing kasi 9am and 6pm lang ung oras available ng kaps, gawa nalang raw kami ng sulat na hinde na kami pupunta at proceed na tayo sa court case...

Not sure kung si innova ba ang kinukulit si kaps or si kaps ang gusto matapos ung case sa end niya...

What is my next move here? the mail didn't say anything about hearing schedule and all, it only stated that a case was filed against me..

Please advise..thank you

first, you check if the letter you received is a subpoena issued by the city prosecutor directing you to file a counter-affidavit within 10 days from date of receipt. if it is, you hire a lawyer and ask him to file your counter-affidavit. if you will not file a counter-affidavit, the case will be resolved by the investigating prosecutor on the basis of the evidence presented by the complainant. second, check if it is a resolution issued by the city prosecutor finding probable cause against you for the crime of malicious mischief, if it is, hire a lawyer and ask him to file a motion for reconsideration within 15 days from receipt and attached your counter-affidavit in the motion for reconsideration. third, to be sure about it, you verify with the office of the city prosecutor about that letter. in going there, you must bring the letter for reference.

it also said on the letter respondent did not appears in the scheduled preliminary investigation of the case. but we didn't received any letter aside from this one.
