Tsips!
Question sa mga may alam regarding fees due to a professional currently employed. Company is going to undertake a BIG project, using the professional's (employee) license for permits, etc. Per Code, the professional can charge as much as 8 percent of the total project cost. Further, whom will the concept/ info and materials used to convey the professional's expertise belong? Per code, these are intellectual property due to the professional, but if she is employed, whom shall these materials belong?
The preparation of materials and information were not done solely by the employed professional, but with assistants hired by the company.
Medyo nalilito si professional kasi di nya alam baka dahil sa project lang na yun kaya sya na hire, after permits etc., company will fire her.
By the way, employee enters into agreement that all the materials/ideas done by the employee shall be a property of the company (breach of the code? employee unaware of the implications before because previous projects were mere barya). The employee by the way is newly hired, entered into probationary contract, lapsed for 2 months now, new contract not yet signed.
Employee is anxious also not to lose job for the time being, mag December, dami gastos but the project concept is due before the year ends.
Need help lang po to info the Employee on how to charge PF na di maangas ang dating at nasa batas.
