    It has been observed BIR agents are harassing restaurants. Reason why restaurants are targeted is because these places are using POS system to monitor their income. This also makes it easier for the BIR to check.

    Is this a move by PGMA to generate election funds for 2010?

    we do not know if it is the basis of the harassment or not. wala na akong tiwala kay GMA eh.

    but afaik, they are also harassing other small businesses too.

    Syempre. My friend's mom is working on BIR and he confirmed this. Di lang na mention kung may involvement si GMA.

    i think it's coz the BIR is pressured to increase its tax revenue coz of massive Phil. govt borrowing this year

    The PASG is also actively harassing warehouses these past few weeks. Mga i-ninspection lang at nakapasa a few months ago, gusto inspection ulit. By the SAME guys of the SAME group, mind you, so I dunno...

    Lahat hina-harass. GMA didn't reach her target revenue so the pressure is on. The problem is, di nila hinahabol ang mga big fish. If we go for the big companies ran by the Chinese, they would have better chances of hitting their target.

    Mga walang hiya talaga ang mga taga BIR na iyan, kahit na nagbabayad ka ng tama, kulang pa rin. Isa na ako sa hinaharass ng BIR, totoo na ng haharass sila. Meron ako maliit na food cart, at pinipilit ng BIR na kelangan ko magbayad ng 250K, 60K may resibo at ang iba walang resibo. Matagal na ginagawa ng BIR ito, pero ngayon gahaman talaga sila. Pag tinanong mo kung paano nila nakuha ang halaga, hindi nila kayang ipakita ang computation, basta ayan na lang ang halaga at bayaran na. Mga walang hiya sila, magnanakaw, at walang patawad. Hindi na sila naawa sa mga nagpapakahirap sa Pilipinas. Ok lang ako magbayad, basta mapakita nila ang tamang computation at lahat ay may resibo, ang problema, wala silang maipakita. Mukha nga na hindi qualified ang mga inspektor dahil iba iba ang nakikita nila. Mali mali ang violations, dahil nakalagay naman ang buong tax laws sa http://www.bir.gov.ph Sila na dapat ang magprotekta sa mga small business owners pero sila pa ang pasimula ng pagbagsak ng mga nagsisikap.

    GMA, akala ko ba trabaho ang gusto mo, eto na nga trabaho ang ginagawa namin, papatayin mo pa. Wala ba kaming karapatan kumita ng konti.

    Kung sakali may makabasa na may tunay na pagmamahal sa bansa at nasa tamang lugar, please please, paki tama naman ninyo ito, lalo na sa RDO ng Paranaque. Ngayon ay Agosto, 2009 para alam ninyo kung sino ang nakaupo sa RDO na iyon. Masahol pa sila sa mga ibang magnanakaw dahil tingin nila ay karapatan nila iyon.

    Crocs store in TriNoma padlocked for tax violations

    The Bureau of Internal Revenue (BIR) closed down an outlet in Ayala-owned TriNoma Mall in North Ave., Quezon City for underdeclaring sales for two years since 2007 and value-added tax (VAT) payments.

    In a statement, BIR Revenue Region 7 regional director Antonio Montemayor said Crocs Store Trinoma Inc. (CSTI) declared sales lower by 163.16 percent in 2007 and 16.54 percent in 2008.

    The retail outlet should have paid P6.38 million and P1.34 million in 2007 and 2008, respectively.

    “Regardless of standing in the business community and the place where trade is undertaken, we will not be deterred in pursuing the mandate of our Oplan Kandado program. Big or small, we will sanction tax violators and close them if they continue to defy tax laws, rules and regulations," Montemayor said.

    All Conditions Gear Philippines Inc., the exclusive distributor of Crocs in the country, declined to comment on the closure of one of its distribution outlets.

    “As of now ACGPI has put on hold all queries regarding the issue. They will, however, release a statement hopefully within this week," the company’s public relations officer said.

    CSTI, which was given time to explain and dispute findings, did not comply with the 48-hour notice and five-day VAT notice.

    Quezon City BIR Assistant Regional Director Jonas Amora said they won't let tax violators go scot-free.

    “Global financial crisis is hitting countries around the globe. The country badly needs more revenues during this difficult time and tax dodgers are only making our country’s plight more difficult. We certainly cannot let this happen. The nation’s interest is foremost," he added. -GMANews.TV

    from friends who are knowledgeable sa tax laws and the way tax law enforcement is done here... it's sad to say na talagang walang protection ang taxpayers when it comes to abusive / arbitrary assessments done by the BIR... parang ang lumalabas, the burden of proof to disprove the assessment is on the taxpayer, the BIR and the government enjoys the assumption of regularity sa kanilang trabaho....

    ang sa akin lang naman... ginagawa ng BIR yung pag sisiwalat ng impormasyon para matakot ang mga nag ne negosyo at magbayad ng "tamang" buwis... pero wala naman silang ginagawang anumang information campaign patungkol sa tamang pag compute ng tamang tax, o kaya ang mga karapatan ng tax payer.. o kaya ang tamang proseso sa mga assessments....

    palibhasa talagang mas malaki ang kita nila (sa sariling bulsa) kung hindi alam ng taxpayers ang mga regulations... parang on their part, there is profit in the taxpayer's ignorance.... pero kung sincere talaga ang kampanya nila, a good information campaign to teach / help taxpayers comply (by telling how to compute, ano ang tax treatment etc.. ) will go a long way sa mga taxpayers para magbayad ng tama at umiwas sa mga nangongotong lang sa loob ng BIR....
