    Hello fellow tsikoters,

    Quick question...

    part of the requirement to file a small claim case is to show proof that you send a demand letter to the accuse.

    question here is that, how can you send a demand letter if you don't know where the person lives? or they change address?

    Situation here is that, may utang yung tao sakin, since 2014 tapos hinde na nagpaparamdam.

    yes, we do have a contract stating everything, the amount, date of payment and all.

    Small claim? Less then P100k? Wala rin naman mangyayari diyan eh. Kahit na manalo ka kung wala rin pangbayad yun tao eh di wala rin. Kung meron man siya properties Hinde mo rin naman pwede kunin kung mas mataas value nun sa utang mo. Susuklian mo pa siya.

    80k po utang niya...

    may work naman siya sa call center..hinde ba siya pwede obligahin ng court/judge na mag bayad kahit magkano?

    o earthlyken, ikaw na naman? kumusta na yung kaso na malicious mischief mo? na-settle na?

    BTT

    walang quick answer yata yang quick question mo.

    1) don't use accuse if it's a civil case. call the other guy defendant. small claims ito di ba? yung akusado, sa criminal yan.

    2) proof that you sent demand? the demand letter and the post office registry receipt with return card. yung last known address ok na yan or the address mentioned in the contract. you had a transaction with him and you didn't know his personal circumstances?

    3) kung sakaling mananalo ka paano mo ma-execute yung judgment against your debtor kung di mo alam yung exact address niya? so ano gagawin mo? kailangan alam mo kung may real property ba siya. so, punta ka sa registry of deeds of his last known address baka may naka pangalan sa kanya para ma - attach mo o mag sleuthing ka baka malalalaman kung saang banko naka-deposito yung kayamanan niya para ma-attach mo rin o sa LTO baka may sasakyan si magulang para ma-attach mo rin.

    4) alam mo kailangan talagang malaman mo yung address, not so much of the requirement that there must proof of service of demand letter, but the necessity of him receiving the court summons kasi kapag di niya na- receive yang summons na yan the court cannot acquire jurisdiction over his person. if the the court did not acquire jurisdiction over his person, any decision rendered by the court is void.

    5) so paano na yan? kailangan malaman mo saan yung ari-arian niya mentioned in no.3 above. kung alam mo na, at di mo pa rin alam saan makita si magulang o baka nangingibang bansa, summon by publication then the attach the property.

    6) kung sakaling manalo kana at na- attach mo yung property niya, i-auction yan ng court sheriff and the proceeds will be used to satisfy his debt to you and the expenses incurred in the auction. the person who won in the auction would only be given a certificate of sale, not deed of sale because si magulang has the right of redemption or equity of redemption before the confirmation of sale (that is, before the lapse of one year from the issuance of the certificate of sale).

    yes, part of the claim for SCC is to show proof that you have sent and the defaulter has received your demand letter.
    that is where stalking comes in..... try to see if you can find a way via social media, google, etc.
    otherwise, you can also try to do some calling first sa office, pero subtle way, just to know if the defaulter is there.
    then send a demand letter there.

    it will take so much of your time (that is why collectors are there). bat hindi mo na lang sila i-hire for a certain commission?
    and yes, tama yung isang post dito:

    a. you will file a case at the SCC
    b. the defaulter will not show up.
    c. the case will be decided (you win, of course, as long as you show proof of debt).
    d. a writ of execution will be issued.
    e. the debtor does not have any money to pay you, nor has the property na pwede mong kunin (under the exception of the civil code of the philippines).
    f. tapos ang kaso. panalo ka, pero di ka makakolekta.

    Hi sir,

    since 2014 papo kasi yung utang niya, palipat lipat kasi to ng tirahan, pero alam kopo san siya nag wowork, pwede kopo ba send yung demand letter sa work place niya?

    regarding sa case kopo sa malicious mischief, wala padin nangyayari...4 session napo na rereset dahil wala palagi si judge at yung 3rd session ay Apec summit kaya na cancel.

    hinde kona masyado iniintindi yung case nayun sir, kasi wala naman mangyayari dun, unang una hinde naman kita mukha ng mga tao dumaan sa innova nila, tsaka hinde nila masabi kung ano ginamit sa pag gasgas sa innova nila, mahilig lang talaga mambintang yun, tulad last month, nakapark innova niya sa ilalim ng mango tree, nahulugan ng manga yung innova niya, result in multiple dents, since madaming bata nakatambay sa area kung san siya naka park, pinag bintanga mga bata...ibang klase talaga ugali nun.. although hassle sa part ko kasi need to attend every session, charge to experience nalang siguru, malas lang at may taong ganito at naging kapit bahay pa namin.

    Going back sa topic po, grabe pala steps para makasingil..kausapin ko nalang ulit at sana makapag hulog siya kahit pa konti konti..
