paano gumawa ng deed of sale kapag may terms (3 yrs to pay)?
usually kasi in consideration of amount received, paano kung hindi pa received complete payment?

ano ang hawak ng buyer kapalit ng downpayment niya?
this is for real estate.
they plan to move in when they gve the dp.
im sure they would feel more secure if may hawak silang papers.

conditional deed of sale ang alam ko, pero pwede ba acknowledgement receipt muna?

is there a form that i can base this receipt/conditional sale on?
malamang papacheck rin ng buyer sa lawyer, baka mapahiya ako.
i noticed a lawyer thread here before, baka meron real estate lawyer na maka-assist.

November 17th, 2005 06:27 PM #9Ang ginawa ko dati Deed of Sale talaga pero stated yung terms of payments thru PDC.. then ng matapos na sya mag bayad saka ako gumawa ng Deed of Obsolute sale.. ganon lang at least pareho kami may protection

hindi deed of sale ang dapat dyan, ang deed of sale e pag fully paid na. a deed of sale is final, installment yang deal nyo e.
CONTRACT OF SALE dapat pag installment. nakalagay dun ang terms of payment, including amount of down payment, mode of payment of downpayment (cash or check, single payment or several payments on a set schedule); interest rate on outstanding balance, terms of installment (like monthly/semi-monthly/quarterly/semi-annual), mode of payment of amortization (cash, post dated checks), dates of payment (set of dates or day of the month, like every 1st of the month); interest and penalties on late payment, terms of forfeiture of payments in case of violation of the terms of payment (like if the buyer fails to pay for 6 months then all his payments are forfeited and his rights to the property will be voided, or will there be a refund and how much percentage is the refund in case the buyer decides to abandon the sale voluntarily); who will bear cost of legal fees and taxes (capital gains tax, real estate tax during period of amortization, transfer of certificate of title, etc.); and schedule of lawyer's fees in case of litigation including where the litigation will take place (example, quezon city regional trial courts).
