    paano gumawa ng deed of sale kapag may terms (3 yrs to pay)?
    usually kasi in consideration of amount received, paano kung hindi pa received complete payment?

    conditional deed of sale yata ang tawag dito.

    sale is only completed if full payment is received

    ano ang hawak ng buyer kapalit ng downpayment niya?
    this is for real estate.
    they plan to move in when they gve the dp.
    im sure they would feel more secure if may hawak silang papers.

    An Acknowledgement Receipt will do stating the partial payment, description of the real estate, agreed sale price, the balance, the terms of payment and of course the signatures of of both parties. A witness signature is optional.

    is there a form that i can base this receipt/conditional sale on?
    malamang papacheck rin ng buyer sa lawyer, baka mapahiya ako.

    i noticed a lawyer thread here before, baka meron real estate lawyer na maka-assist.

    Ang ginawa ko dati Deed of Sale talaga pero stated yung terms of payments thru PDC.. then ng matapos na sya mag bayad saka ako gumawa ng Deed of Obsolute sale.. ganon lang at least pareho kami may protection

    hindi deed of sale ang dapat dyan, ang deed of sale e pag fully paid na. a deed of sale is final, installment yang deal nyo e.

    CONTRACT OF SALE dapat pag installment. nakalagay dun ang terms of payment, including amount of down payment, mode of payment of downpayment (cash or check, single payment or several payments on a set schedule); interest rate on outstanding balance, terms of installment (like monthly/semi-monthly/quarterly/semi-annual), mode of payment of amortization (cash, post dated checks), dates of payment (set of dates or day of the month, like every 1st of the month); interest and penalties on late payment, terms of forfeiture of payments in case of violation of the terms of payment (like if the buyer fails to pay for 6 months then all his payments are forfeited and his rights to the property will be voided, or will there be a refund and how much percentage is the refund in case the buyer decides to abandon the sale voluntarily); who will bear cost of legal fees and taxes (capital gains tax, real estate tax during period of amortization, transfer of certificate of title, etc.); and schedule of lawyer's fees in case of litigation including where the litigation will take place (example, quezon city regional trial courts).

    tapos pag fully paid na siya, then will be the time to sign the deed of absolute sale.

    as for the form, alam na ng lawyer yan. wala ka naman kawala sa lawyer e, since dapat notarized yan saka ipasok pa sa records sa register of deeds (i think lalagyan ng copy ng contract of sale yung land title sa register of deeds). basta inumerate mo na lang sa lawyer ang gusto mong terms (usap muna kayo ng buyer kung ano yung terms na mag-agree kayo para di doble gastos kung may hindi kayo magkasunduan sa terms) tapos bahala na yung lawyer gumawa ng contract of sale.

    i already got a draft of the conditional deed of sale.
    if ever may mangangailangan in the fute, may copy na tayo =)

    additional question; sino ang pipirma sa deed of sale? the owner, or pwede na ang attorney-in-fact?

    Yung ginamit ko kasi sa pag bili ng used car na may terms Deed of Sale then ng matapos na mabayran at mag kalipatan ehh Deed of Obsolute sale..

    Pero yung Real Property... Contract to Sell talaga dapat

    san ba mamakaka copy ng deed of conditional sale na form? yan din kc problema ko eh.. need ko deed of conditional sale. binbenta ko kc property ko rent to own sya. pashare naman kung may form kayo ng deed of conditional sale.
