    Well, some of these GI's just couldn't keep their pants zippered shut. There had also been a recent rash of ***ual assaults and murders by individual GI's in Japan, not to mention undocumented accounts of two-timing by married GI's (and their spouses).

    may kutob ako, that the three other accused that were acquitted was the result of a somekind of bargain between the US and Phil. government.

    Para bang, sige ibigay namin sa inyo si Smith, pero ibalik nyo sa amin yung tatlo. At least we got one. Something to that effect.

    Well, considering that the vast majority of GI offenders often get spirited out of the host country by their commanders (especially those guilty of lesser/petty crimes), I'm surprised there was even a conviction.

    Nah. I don't think he'll do time in the City Jail. Although he'll probably do jailtime in the Philippines, he'll be held in some US-spec jailcell with all the amenities and paid for by American taxpayers.

    IIRC, he will be detained in a facility jointly agreed upon by the Philippines and the US, if the Supreme Court upholds the verdict.

    Pansin ko lang, bakit parang sa Kia Pride sinakay si Smith pagkagaling sa korte? May kasama pa siyang police escorts, nagkasya kaya sila dun?

    tingin ko rin playing safe yun judge, parang 50/50 meron guilty meron accuited, so bahala na court of appeals or kung umabot mang sa SC, sila na bahala kung i uphold or i overrule yun decision niya, tutal matagal tagal pa yun at wala n siya sa limelight...

    i dont get it...Ang ito ang pagkakaalam ko, ni rape sya sa starex and all of the GIs including the driver were there... question>>bakit isa lang ang guilty di ba kahit papaano may participation yung iba..accessory to the crime din sila dapat may parusa din sila!!!!

    baka nga nga nagkaroon ng bargaining between rp and us?

    at least we got a piece of them. all the while kala ko nga wala nang mangyayari sa rape case na yan.

    I'm no lawyer. But if it boils down to the victim's word against the accused and there were no other witnesses to the actual rape, it falls on the physical evidence found inside her which probably was Smith's and Smith alone.

    She could say all she want about them cheering Smith on. But, unless there's conclusive proof like a camera/tape recorder footage, a witness, or if they rat each other out, then there's no real way to prove their guilt. They could always feign that drunkeness impaired their senses so much that they didn't notice what was going on.

    personally, tingin ko consensual nangyari, pero siguro napahiya na si nicole dahil iniwan siya sa gilid ng kalsada and meron na rin nakakita sa kanya na ganun...kaya sinabi na lang nyan rape, I think she's a loose girl...base sa mga lumabs ng stories, pumapayag sia na mga kano magbayad ng hotel niya, etc...tingin ko lang naman...

    Well, even hookers are accorded the protection of the law when it comes to rape, as strange as that may seem.

    "No Means No" had been preached to GI's (including yours truly) ad nauseum for a long long time. Yet, there's always some bonehead GI who still fails to get it.... Always thinking with his dick.....

    Smith can of course appeal to the Court Of Appeals.

    However, the prosecution cannot appeal for the retrial of the 3 that were acquitted. They're already free individuals.....

    In my views and without having examined any bit of evidence from either or relating to the parties involved, this court trial seem like a farce that pits the supposed oppressor against the oppressed. It exudes this sense of predictability in the situation of Smith being prosecuted no matter what.

    I have serious doubts of the veracity of this "Nicole"'s reputation. She's a hooker and if she says "no" to these American then what was she doing with them then. Why did she allow herself to get drunk? Doesnt she know what happens she gets drunk?

    And one more thing, a great majority of our society do look up to foreigners esp. the caucasians. For example, there is this American in the mall who gets by at the entrance without getting frisked by the guard while the rest of "us" go through the standard procedure of being frisked. In another incident, sales ladies in the dept. all of a sudden crowd around this male American, suddenly becoming extra helpful and locquacious when just seconds ago, they looked like they were about to fall asleep. In other words, for some reason, foreigners are accorded special treatment and even at times, looking over our shoulders when they do wrong. Now back to Nicole, I find it hard to imagine why would a hooker turn down green-back totting American GI's. Its her once in a lifetime oppurtunity to make more than the usual take.

    I do find the deed that Smith did with Nicole wrong based on my religious beliefs, but that is not the issue here. I think this Nicole seems like a gold digger of some sort. Perhaps even going through lengths to distort facts for personal gain and fame. But unfortunately, that, we could never know for certain.
