CA finds columnist guilty of libel

THE Court of Appeals yesterday upheld a lower court’s ruling which found tabloid columnist Raffy Tulfo guilty of 14 counts of libel after it found “actual malice” in the articles he had written about customs collector Carlos So.
Sentenced along with Tulfo to a jail term of 28 years were Abante Tonite publisher Allen Macasaet and managing editor Nicolas Quijano.
The 72-page decision dated July 31 and penned by Associate Justice Andres Reyes Jr. also ordered the three to pay So over P14.7 million in fines and moral, exemplary and compensatory damages.
“It had been held many times by the highest court that there are statements which would not be covered by the Constitutional protection. In this case, there was enough proof of actual malice,” the court said. “There was also enough proof of ‘reckless disregard of whether they are false or not.’ Thus, the said articles are indeed libelous,” it added.
