    [SIZE=2]Makati Mayor Jejomar Binay said Wednesday he will not suspend his city’s traffic code despite the issuance of Executive Order 712 that directs the implementation of a single ticketing system for Metro Manila.

    Binay said EO 712 violates Republic Act 7160 or the Local Government Code of the Philippines that gives local government units sole authority to regulate traffic in their respective jurisdictions.

    Binay is one of five Metro Manila mayors who oppose the implementation of a single ticketing system.

    Under this system that would be set up through EO 712, Binay explained that the Metropolitan Traffic Ticket (MTT) will be the official traffic citation ticket to be used by traffic enforcers of the Metropolitan Manila Development Authority (MMDA), LGUs and duly deputized agents in apprehending traffic violators in the metropolis.

    "The Supreme Court has already defined the limits of the MMDA's mandate, ruling that it has neither legislative nor police powers. Decisions of the Supreme Court are part of the law of the land," Binay maintained, adding that EO 712 cannot supersede the country’s national law.

    The mayor said two Supreme Court rulings have already defined the mandate of the MMDA as a purely administrative agency tasked to coordinate development projects in Metro Manila.

    "Thus, even if the Metro Manila Council, which is the policy-making body of the MMDA, agrees to a single ticketing system, the respective city or municipal councils would still need to pass the necessary ordinance before it can be enforced in a particular locality," he said.

    He said he would not suspend Makati’s existing traffic code despite reported threats that charges will be filed against local chief executives who will refuse to comply with the executive order.

    One-month deal

    Meanwhile, transportation groups said they will give the Arroyo administration one month to implement EO 712 as they warned that they will hold bigger rallies if the government fails to keep its promise.

    Efren de Luna, president of Alliance of Concerned Transport Organizations, warned that public transportation may be paralyzed again if the five opposing mayors defy the executive order.

    Aside from Binay, the other mayors who oppose the system are Pasay City Mayor Wenceslao "Peewee" Trinidad, Navotas City Mayor Toby Tiangco, Manila Mayor Alfredo Lim and San Juan Mayor Joseph Victor "JV" Ejercito, all of them identified with the anti-Arroyo bloc.

    Transportation and Communications Secretary Leandro Mendoza , meanwhile, assured the transport groups that the government will do its best to convince these mayors.

    Leaders of the transportation groups, Mendoza, Chairman Thompson Lantion of the Land Transportation and Franchising Regulatory Board, Director Geary Barias of the National Capital Region Police Office and Chief Superintendent Leopoldo Bataoil, head of the Directorate for Police Community Relations, held a Thanksgiving lunch a day after the Metro Manila-wide transport strike.

    One word: REVENUE. Or in other words MONEY. If we have a single ticketing system the MMDA is the one who will get the money and not the local governments. Sometimes MONEY > COMMON SENSE....

    Apart from the potential revenue, pride may be another reason why a handful of mayors are opposing the ordinance.

    They probably feel that such blanket mandates are emasculating (for lack of a better term) the city government's prerogative with regard to traffic regulation. They don't want their constituents to perceive them as ineffective administrators of their respective jurisdictions. Apektado kasi ang PR nila eh (or what's left of it). :D

    baka conflicting naman talaga yung EO sa existing laws na nagawa na, just like Binay's statement that EO may not supersede national laws. or baka ginawa lang yang EO para tumahimik yung mga nagrally. tsk..tsk..

    People should benefit from the law. People actually want this single ticketing system. Theres really no point in using the law to stop something that is good for the people.

    Binay really is an a$$. He wont even say what are the disadvantages of this scheme. AFAIK, their yellow boys would still be the one managing the traffic. They will just use a different ticket for violations. Aside from lesser income for their municipality (which I think is just cents compared to the taxes paid by businesses in Makati), I cant see any other reason why he is not in favor of this.

    if you get caught what can they do if you dnt give them your license? are they conected to the LTO? if they are conected to LTO.. then they dnt have to take your license because they can trace you... if not then what can they do? do Local governments have their on local LTOs? what i really think is that LTO and TMG should be the sole aprenhending body to catch violators.
