I'm not a lawyer so this is just my 2 cents worth..
It would not matter if the victim was the one armed with the knife and one of the 4 grabbed it from him and killed him with it. It's still murder, through the use of an edged implement. Ownership of the implement has no bearing. The victim could have been stabbed to death with a sharp piece of pipe found nearby and the result would still be the same. It's bad enough that they ganged up on him, 4 vs 1, and they had to escalate the attack by stabbing him. There's no doubt that he was stabbed by one of the attackers, unless the lawyers can prove that the victim stabbed himself (I think the stab wounds are to his back and shoulder).
It's not unlikely that the 4 had knives on them. Believe me, a lot of people in Metro Manila, even rich kids, carry knives. Based on the video I saw of the case, the knife is a Emerson Commander, which retails for around Php 10,000. Easily affordable by those who can buy Volvos. According to the police report, there were other knives found in the vehicle.
Yup! And a tactical knife that small is easier to bring with you than a handgun.
Obviuosly, you are not a lawyer.
The lawyers of the accused can claim that the knife was brought out by Anikow, and the stabbing was a result of Self-Defense after being wrestled away from the victim.
"Do not under-estimate a lawyer's capacity to lie", my cousin attorney always says.
if we want to blame someone here.... blame the private prosecutor....
Moral lesson:
Mind your own business. Sa mga panahon ngayon almost everybody out on the streets can pose as a threat to security and safety. If it does not concern you, don't enter the situation and endanger yourself or your companions.
Ang mga bayani, pinapatay ... morbid as it may sound pero its true!

I'm very curious how the case will be handled considering the victim is a US marine and the wife is a US expat.
If the US wants to pursue the case, parang walang laban ang anak nila mama at papa. Bigating pulitiko that would risk his career lang ang pwede magareglo
The guy in a Major with the US Marines RCT-3,
