    alam niyo may m.o. din diyan sa vito cruz corner roxax blvd. pag stop may maglalakad na mama parang naghahanap ng target (bagong sasakyan ang gusto), tapos pag go na, biglang tatawid sa harap ng sasakyan mo at kakalampagin ung sasakyan mo na parang malakas ung banga sa kanya. nangyari sa tatay ko, e alam niya na peke lang, bumaba na parang bubunot ng baril sabay mura, biglang tumayo yung nabanga at tumakbo. takutan lang yan minsan.

    well in the US they're offering "black boxes" sa cars, parang sa plane. it will lower your insurance premium kasi mas madali ma-settle ang accidents etc. lahat ng readings ng engine computer within the past X minutes are stored, so alam kung nag brake failure, or if you were accelerating or decelerating, etc. etc. etc.

    kulang nalang dagdagan ng low-light camera sa harap ng windshield mirror, that sees everything in front. para kung nagka-lechehan, meron kang hard evidence (unless ikaw yung may kasalanan, hehehe..)

    baka may market ito, like aftermarket backup sensors. iwas hassle pa sa police report.

    Sakit sa ulo ah... hayyyy.... guess minsan tama si Bayani sa mga iniimplementa niyang policies... talagang kailangan higpitan para matuto...

    Only problem mga mayors pag dun nagreklamo mga engot syempre voting public un... tiklo na agad si Bayani...

    Ang inaalala ko lang for example, kasama mo gf mo o mom mo sa kotse and you're driving on EDSA then may ogag na tumawid, iniwasan mo sya pero sa pag preno mo nabanga ka sa likod. So you and your passenger goes to the hospital pero sino magbabayad nun? Mahahanap pa ba yun ogag na tumawid? Wala nga disciplina kung sa wala pero our Laws should lean on who is right and not on who's wrong. Hindi yun nabanga mo na dahil ogag tapos dadalhin mo pa sa ospital tapos babayaran mo pa. Tama nga na mas importante yun buhay, but considering that you and your passenger could be the ones ending at the hospital and di naman yata fair yun.

    I hope that we have a lawyer here who can enlighten us on the law regarding this. Alam ko basta kailangan mo dalhin sa ospital e, but we shouldn't even be obligated to pay a peso to this inconsiderate fools.

    hehe ganun talaga ang batas. because driving is just a privilege and not a right. with these privileges come responsibilities. among which is the safety of people around you. when you drive a vehicle, you are the most likely to cause serious injury or death to other people. i don't think a pedestrian ramming into you will cause the same damage. so the burden of prudence all lies with the driver. in the case you cited, it can always be argued that you were driving too fast and you lacked the foresight (which means you were negligent of your responsibility) to anticipate the pedestrian-no matter how stupid was his manner of crossing. it would be very hard to prove in court that it was the pedestrian who was negligent (becuse he has no responsibility for the safety of motorists in the first place) unless he himself admits it. bad trip no? but thats the way it is. so i guess we just have to be very very careful knowing that these things could and do happen.

    btw, i'm not a lawyer but my dad is. and that was his tip before when i was still learning to drive. ;)

    Pedestrians always have the right of way. Pero dapat sumunod sila sa tamang paraan, tawid sila sa tama. Pag nabungo sila ng wala sa lugar, hindi dapat liable ang motorista.

    Kapag driver ka, kainis kapag maraming pedestrians na nag va violate ng rules, same way kapag pedestrian ka, kainis mga driver na walang alam sa traffic rules.

    Pag driver ako, inis ako sa mga pedestrians na tumatawid basta basta kung saan saan. But I still consider them to have the "right of way" all the time.

    Pag pedestrian ako, inis ako sa driver na ayaw magpatawid sa PEDESTRIAN LANE. Dapat sa mga ganong driver hindi binibigyan ng license!!! I wonder kung may nakakalam sa maraming drivers na when approaching a pedestrian lane dapat HUMINTO at patawirin ang pedestrians especially duon sa mga pedestrian lanes na WALANG traffic light.

    Disiplina lang yan eh. Sa Singapore nasa sidewalk pa lang ako sa may gutter malapit sa pedestrian lane, yung mga cars humihinto na, walang traffic light yun ha. Dito sa atin, nasa gitna ka na ng pedestrian lane BUBUSINAHAN KA NG MGA LINTEK NA DRIVERS NA YAN, TATARANTAHIN KA, IBIBLINKER KA PA, AT KAPAG NATUWA PA SAYO, PIPINAHAN KA PA SABAY MURA SAYO NA "ANG TANGA TANGA MO". Sino kaya ang mas tanga? Shempre I am talking about sa pedestrian lane na WALANG traffic light. Dahil kung may traffic light dapat sundin mo yun, just because nasa pedestrian lane ka doesnt mean pwede ka ng umastang parang princesang pwedeng tumawid kahit anong kulay nung traffic light.

    i agree. and a vehicle should always stop or give way to pedestrians on a clearly marked pedestrian lane that has no stop light. yung iba talagang motorista kasi nakakabadtrip e. haharang sa pedestrian lane or di magpapatawid. kaya nangyayari e gantihan lang. hehe.

    well, to make it equal, if we free motorists from liability if they hit a pedestrian who is not crossing in the right place, then we should also allow a pedestrian to walk over, destroy a car or kill, injure or maim a driver if it/he/she is on the pedestrian lane or parked on the sidewalk. now that would be anarchy. hehehe

    i'm not a lawyer either pero in this day and age, dapat i-update na ang "privilege" na ito (ie. the privilege to drive on the streets). di ba we have this doctrine of last clear chance? e kung mabilis talaga takbo mo kasi nga nasa EDSA ka tapos may tumalon sa harap mo para magpatiwakal, e di according to the doctrine dapat yung lintik na nag-suicide ang liable pati sa gastusin mo sa kotse.

    sadly, wasn't it the late great pres magsaysay (not sure) who proclaimed that those who have less in cars should have more in roads? napakaganda sana sabihin talaga pero look at the (road) anarchy this thing brought upon us.

    tingin ko pag wala sa lugar yung pedestrian talo yan sa court....lalo na sa slex/nlex, major streets with ped xing...


    ang wlang laban ang motorists ay yung mga sa side streets..gaya ng mga vilages, subdivisions, national highways etc.

    tama ba?

    Wala naman problema kung sa tamang tawiran e, i always slow down whenever i see a pedestrian crossing or intersection. Yun mga wala sa lugar tumawid yun nakakainis, i don't even care about my car kung masira at mabanga, what i care abt is my pasenger and myself. Hindi fair o well defined yun batas siguro. Pero may nabasa nga ako sa newspaper before that drivers are not liable for anything if the pedestrian is jaywalking. Gusto ko lang may mag confirm.

    Although I love to drive, I was also a pedestrian during most of my school years in the Philippines. During my time there, I've noticed that the big majority of pedestrians used overpasses and underpasses whenever possible. If there's a pedestrian light, the big majority of them crossed only when it's green and ok. This was back in the late70's and early 80's. If there has been a breakdown in discipline since then, I don't know. But, I've always leaned on yielding to pedestrians regardless of whether I'm in the right.

    The last place I drove similar to the Philippines would be Turkey which not only has a pedestrian discipline problem, but also problems with motor vehicles sharing the road with oxen and horse-drawn carts. I had to take it upon myself to be a defensive driver at all times, learning to avoid known chokepoints as much as possible and always on the lookout for the unexpected. There were a few days when the car I'm driving literally crawled all the way to wherever I was going. There were just so many pedestrians to deal with. But, that's just the way it is. Pedestrians do have the right of way in most countries whether they abuse the road or not.

    Abusive pedestrians have been part of Philippine culture since like forever. My Dad had to deal with it when we arrived in the mid-70's. I'm not surprised that it's still a problem now.

    Once the Philippines start really progressing and most EVERYONE has a car, then the real road problems will start. I've seen terrible road traffic in Seoul at the time S Korea's economy really took off in the early-mid 90's and almost every household had a car. Sometimes the traffic would be backed over 6 and 8-lane freeways all day. It paid to just leave the car at home and use Seoul's excellent subway system.

    There's a lot worse places in the world to drive than the Philippines.

    Nakasagi ako ng pedestrian the other day sa may Congressional. KULANG BA SA LAKI YUN OVERPASS DUN NA KULAY BLUE, AKO LANG BA NAKAKAKITA NUN????? Puro jeep at bus na nakaharang sa kalsada, pati tao nakikisingit pa. Sayang naman yun tax money na binayad dun sa overpass na yan. Kung binigay na lang sa mga pulis yun baka sana ganahan pa sila manghuli ng jaywalking at illegal loading/unloading dun. Hay!

    Akala yata nila pang Billboard yun eh. Kung escalator siguro yun hagdan baka, BAKA sakali gamitin na nga ito. Hay!
