    It seems to be the trend in the Philippines to arrest the person who is not at fault of a fatal accident. Just like the Everest vs the Bus. How do they expect a train driver to stop on a dime to avoid a trike that not even crossing at a railroad crossing. Was watching it on TV patrol it it just made me angry. One the reasons I have a foward and rear facing camera on my vehicle.

    MANILA, Philippines – Five people died after a train rammed a tricycle in Iriga City, Camarines Sur on Friday morning.

    Constancio Toledano, Philippine National Railways (PNR) operations manager, admitted there was no crossing keeper stationed in the area when the crash occurred, but insisted that the train’s driver sounded his horn repeatedly.

    The tricycle driver, Danilo Doroteo, continued crossing the railroad because he allegedly did not hear the horn due to his hearing problem.

    The tricycle reportedly had at least 12 passengers, composed mostly of students who were on their way to school.

    The following people died:

    Danilo Doroteo, 51 (driver)
    Shiela sapinoso, 32 (public school teacher)
    Kent Lester Doroteo, 12
    Kimberly Doroteo, 13
    John Richard Rosal, 15

    Meanwhile, the following students were injured:

    Mikee Villanueva, 15
    Hanny Mae Baal, 12
    Ronnil Rodilas, 13
    Loren Legada, 12
    Jessa Bareno, 17
    Joshua Salamanque, 14
    Hanson Baal, 15
    Angelo Zoilo, 15

    The PNR promise to extend financial assistance to the families of the victims.

    Meanwhile, the train driver, identified as Froilan Ollero, is facing multiply homicide, physical injuries and damage to property.
    Note there where 14 people on this one trike. So basically you can just hit any larger vehicle and it's the larger vehicles fault no matter how obviously at fault the other drive is like passing on a blind corner with a solid line that shows you can't pass or on a speeding train that takes 1000's of feet to stop when somebody in a overloaded trike who does not have the common sense to look before he crosses the track.

    This kind of logic is embarrassing.

    Just saw this in the news tonight.

    I doubt the train driver will be convicted. Mukhang solid ang backing niya from PNR. Also, aminado naman yung wife nung deceased driver na mahina pandinig nung driver, which explains witness accounts saying that despite the train's continuous honking, the trike continued to speed up.

    The trike was also overloaded at the time, which is why the driver passed a back road in the first place, to avoid scrutiny by provincial officials. 8 lang daw ang max. capacity ng trike, though I think even this number is too high. Not because the trike is underpowered, but the brakes aren't designed to handle such weight. Also, ano nalang mangyayari sa mga nakasabit pag nagkabanggaan - fly fly away na.

    Sobrang bobo talaga ng mga batas natin, lahat ng may common sense alam na kasalanan toh ng trike driver. Nabuhay ba yung bobo na trike driver?
