    MC rider may kasalanan, rip pero cya nga initiate nang contact. Yan ang hirap sa batas naten wala kang kasalanan kaw pa makukulong. Sample din ung mismong kalye na no jaywalking at may overpass tapos makakasaga ka kasalanan mo pa.

    walang paraan para maiwasan ng truck driver yung nangyare unless sa sidemirror sya nakatutok at hindi sa harapan nya.

    Dapat ilaban nya ito hindi lang sa korte pati rin sa media para malaman ng tao ang limitasyon ng pagdrive ng motor.

    RIP sa motorcycle driver.

    It's actually the PUJ's fault. They're the cause of a lot of accidents because of their haphazard way of driving.

    kung meron lang sana tayong loading/unloading bay para hindi na tayo maabala ng mga PUV na akala mo sila lang ang mga motorista sa daan

    Bakit sisisihin yung PUJ? Hindi porket huminto yung nasa unahan mo pwede ka na sumingit sa ibang lane para mauna ka. Yan yung ginagawa talaga madalas ng mga MC rider. Pag naipit sa kanan, kadalasan, bigla bigla na lang lilipat sa kabila at kakainin yung linya nung nasa tama. They are right, dapat may isang law maker na magpasa ng bill na poprotektahan yung ibang drivers na sangkot sa ganitong klaseng aksidente. Dapat nga sila pa ang pagbayarin ng danyos dahil sila ang proximate cause.

    Our law really sucks lalo na sa mga ganitong klase ng incident at eto ang disadvantage nung tinatawag na due process of law. It must be proven beyond reasonable doubt, unfortunately, habang nakakulong yung inosente.

    1. ung driver nakaupo sa car, pwede naman palagpasin muna un tumatawid bago umabante.

    Boy... I sure hope our law makers pass a bill to correct the stupidity of the system where vehicles get blamed for the stupidity of other people. What if a guy is suicidal and throws themselves in front of a speeding vehicle on the expressway? Do they still blame the driver? Geez... RIP to the MC rider but she was at fault. I can understand why the dad wants justice but he would have to be blind if he thinks his daughter has no fault in the incident.

    This actually happened to someone I knew. Buti mayaman sila at aminado naman yung pamilya ng namatay na may topak yung kaanak nila dahil adik. Binayaran na lang nila yung hospital fess at paburol dun sa namatay.

    Lesson sana ito sa mga buhay pang mga motorista, skills, talent at perception ang kailangan pag nasa kalsada.
    Sa tingin ko baka galing pa sa duty nung rider, o baguhan kaya ganun na lang kung mag-analyze ng sitwasyon.

    Mukhang nagsarili lang yung motor. Kahit yung jeep wala namang kakaibang movement. Yung motor overtake sa jeep at hindi bumawi ng kabig.

    Ang suspetsa ko puyat at kulang sa concentration ang motorcycle driver.

    Ang personal rule ko, huwag tumabi sa mga truck. Kahit naka 4 wheels ako, iniiwasan ko yang mga yan.

    Sa batas natin, kung sino ang meron last chance na umiwas at hindi umiwas ay sha ang meron sala.


    1. nakita ni truck driver na sumingit si MC sa likod, tapos hindi sha nag bigay, kasalan ng truck driver.

    2. hindi nakita ni truck driver na meron sumingit sa likod nya, tapos sumabit si MC rider, walang kaso ang truck driver.


    Magulo ang batas natin, pera pera ang labanan, kung walng pera ung truck driver at willing gumastos ang pamilya ng MC driver, kawawa ang truck driver sa kulungan.

    #2 is self-explanatory. If you don't see anything, how can you avoid it?

    #1 medyo magulo. Nakita mo sa likod tapos hindi ka nagbigay? That's assuming you were turning or merging into the same lane, I suppose.

    In this case, I would think #2 would apply.

    The truck is in the leftmost lane. The right lane occupied by another vehicle. What would they have the truck do? Go left into the lane going in the other direction and possibly cause another accident?

    Basic driving discipline dictates that one's eyes should always be looking at the direction one is going. The only time you should take your eyes off towards the front is when you're reversing or checking your side mirrors if you're turning or changing lane.

    This is what idiots on the road can't understand. They shove themselves into inappropriate/dangerous positions and expect people to have eyes on the back of their heads and give them way.

    lesson learned from this incident is.

    when you are afraid to stop at the scene of the accident (baka mabugbog), go to the nearest police station.

    kahit walang kasalan ang truck driver, since lumalabas na hit-n-run nagkaroon pa tuloy ng butas ang depensa nya.

    Tama, kapag fearful sa buhay mo, go to the nearest police station na lang. Pero sa case kasi na ito, dapat huminto talaga siya. Nasa highway naman eh, hindi eskinita na maraming bystanders. Hit and run tuloy kaso niya. tsk tsk

    Anyways about the law, i think may batas naman na sa cases na ganito in favor of drivers sa current penal code natin. Art. 12. Circumstances which exempt from criminal liability. — the following are exempt from criminal liability: ...... 4. Any person who, while performing a lawful act with due care, causes an injury by mere accident without fault or intention of causing it.

    Parang pasok naman circumstances ng driver nung truck dito, yun lang walang ligtas sa abala dahil may imbestigasyon pa rin.

    Yung mga MC driver kasi, hindi pwedeng maging idle. Napansin nyo ba yun? Kapat naipit sila, parang iritang irita na sila. They must be continuously moving. Maybe its the heat of the sun, or the pollution, or dahil wala silang security if they are moving. The cons of driving a two-wheel vehicle perhaps.

    One less MC driver on the road.
