Road Incident, Kung sino pa yung at fault sya pa magdedemanda, need your advise please

Good evening, I need your advise po on what to do sa situation na ito.

Last week, I was involved in a road incident. I was on my way home from Filinvest to Las Pinas. Traffic wasnt heavy but there was a slight build-up that time, incident happened near Mcdonalds along Alabang-Zapote road a little past 10PM. I was driving my Honda City and on my front is a Toyota Innova. Medyo slow moving ang mga sasakyan when suddenly instead of accelerating, pa-atras si Innova. I realiized na mababangga ako so busina nako ng busina until the Innova collided with my Honda City. My wife was first to approach them and driver of the Innova and his wife was apologizing, they are explaining how they are lost and they are trying to "waze" their way home to Mandaluyong. Finally, policemen arrived at the scene but they said hindi daw sila yung investigator sa mga road incidents. So we waited for the investigator until another policeman arrived saying that madami daw trabaho yung investigator so we have to bring the cars sa HQ nila which is near Petron sa Southstation Muntinlupa.

When we were there, ayan na. Iba na ang story nila, Their statement was that bigla na lang daw silang na hit sa likod. Of course, ang statement ko is kung ano ang tunay na nangyari,

Also, on a side note, hindi marunong magsulat at magbasa yung driver ng Innova so he had to be helped by the staff dun sa police HQ. I wonder how he was able to obtain a driver's license,,

So back to the incident, since the damage is not that Major and yung driver ng Innova is not admitting that he is at fault plus I think madami ding shortcoming ang investigator para makapag conclude kung sino nga ba ang nasa tama, my wife and I decided na, idadaan na lnag sa insurance since insured naman ang sasakyan. But to our surprise, the other party was saying na magdedemanda sila dahil sila daw ang binangga, at madami naman daw silang relatives na abogado.


need your advices po on what to do if they push through sa pag demanda. As for me, I dont have the fund right now para mag demanda din. Nakakalungkot lang isipin na ikaw na yung agranyado , babaligtarin pa ngayon na ikaw daw ang "at fault".

you don't have a fund right now so you're here asking for our advice.

the way i look at it, you have a legal problem which you need a legal representation. no amount of advice can get you out from the mess you are in right now except you engage the services of a competent counsel.

you drive a Honda city (is it brand new?), most probably you cannot get the services of the public attorney's office because you can hardly be considered a pauper litigant.

my advice goes something like this, you file a criminal case against the driver for reckless imprudence resulting to damage to property. go to the police station and ask the police to file it for you. this is to give you leverage against the Innova owner or driver. you don't need a lawyer at this point because you have the prosecutor's office of the place where the crime was committed to represent for you.

di na kailangan. the case is very simple. the parties should be ashamed of themselves going to court and ask for redress. they just aggravate court dockets to new heights.

BUT, and there is always a but, people seeks justice. and there's no injustice greater than a person who is called to pay for something he did not owe in the first place.

As per your story, ikaw ang naatrasan at nangyare ito sa gitna ng traffic.
Since, wala kang substantial evidence like dashcam video at hindi naman umamin sa police report ang driver...mapa-fall talaga yan sa kung sinung bumangga sa rear sya ang may fault, ibig sabihin napakalapit mo at hindi nasunod ang 1 vehicle clearance.
As per my experience, hindi mo pa kelangan ang lawyer sa ngayun meron pang 3 meeting kayo sa piscalya para mapag ayus ang lahat and usually kung minor scratches/dents lang ang damage dini-discourage na ng prosecutor ang magkabilang panig na wag ng ituloy ang demanda at mag-areglo na lng.
For example " mag areglo na lang kayo, gusto mo bang makulong ng dahil lang sa halagang 20k?", " pag-usapan nyu na lang ito, maabala lang kayo pareho, at ikaw na nagdedemanda ang magbabayad ng php500 kada hearing at ang ganitong kaso inaabot ng taon bago madisisyunan"
Kaya sa dulo, aregluhan din ang uwi ng lahat, not unless sadyang matigas kayu pareho at willing maabala at gumastos ng more than sa damage incurred 😄

Follow the advise of the lawyers here and on the side, get someone to vandalize that Innova para makabawi ka. Someone have to teach that asshole driver.

this incident prompted me to get a decent dashcam. Di mo pedeng iasa na magiging tapat ng tao ngayon, you need evidence.

I had a similar incident diyan sa S&R Alabang a few years ago....

I was behind a car which stopped. And so I stopped too about a car-length behind. And then suddenly the car reversed (moved backwards).... I still had time,- so I warned the driver by blasting my vehicle horn, without let up...

Oh man,- he still hit me... And upon hitting me, he suddenly turned left (I was thinking,- he was trying to find the exit and being unable to do so),- he parked... And so, I stopped my vehicle and confronted the driver,- who was acting dumb and numb and proceeded inside S&R... T*ngna,- grabe talaga... I could have whacked him if I haven't checked myself... Worse,- he was with his wife and kid, and not owning up to his mistake.

The people who witnessed the incident approached me and collectively told me, "Pare,- butasin na lang natin ang gulong ng walanghiyang mama na iyan,- sobrang kapal ng mukha niyan....". I think that they were just waiting for my green and go and they would do it on their own, as they were as mad as I was. I just told them,"Huwag na lang bros.,- makakahanap din iyan ng katapat niya"

Gasgasin ang kotse? It would not make any difference, as his car's paint was heavily oxidized,- and there were no more space for scratch.... As I was writing this,- I still feel the anger that day,- as this kind of people should be confined to cages, out of our civilized society.

BTT: Ang daming ganyang tao,- dapat sa mga iyan,- turuan ng leksyon... So much entitlement for these people. No one owns up to his/her mistakes anymore, - no matter how obvious they were....

nangyare din saken yan. nabundol ako ng mahina sa likod pero may chipped spots dahil sa plaka nya. it was a sta.fe suv driven by a girl. hindi daw sya tumama (umatras sya konti after hitting) and ung dalawang sakay nya nag agree di nga daw tumama. it didn't help mejo marumi ung rear bumper ko sa mga gasgas, pero syempre kabisado ko naman kung nasan ung luma at bago. ginawa nila akong sanggol. hindi ako nagpa bayad or nag demand from the onset, a simple apology or offer would've been great, but still tatanggihan ko pa rin un. not sure why hindi pa rin nya tinanggap ung offer to come clean at zero peso cost, mas mahal ang pride kasi minsan.

hay, i think you have been a victim of a modus wherein they intentionally backup their car to you since they know the government is useless and cannot respond to the incident, thus threatening you to pay them for the damages... kase kung pumunta pa kayo sa south station at sumama sila para lang baliktarin ang kwento meaning modus nga yan, kase pwede naman sila tumakas at di na sumunod sa south station...

thats all i can say, i can't say i believe your story or not because i did not see it... but based on your story, thats what i can say...

Guys, just had a confrontation now with a road rage guy.
We were traveling along ortigas coming from c5. The outer 2 lanes would merge and everyone was doing alternate entry into the outermost lane. When the traffic moved, it was my turn into the lane. No gitgitan happened. I was entirely into the lane when a white patrol was honking and driving crazy with headlights on, stalking me and giving me the bad finger. I was just calm and rolled down my window to show my face and ask what was his problem. He still was bad fingering me. Traffic stopped and he was beside me. He opened his rear window a bit to show his finger again. He also opened his door and stepped on the door ledge, stood up and shouted loudly "aaaaaarghhh!!!"
I still stayed on my lane not minding him but he slowed down and stayed behind me. I was on my way to the hospital which was a few hundred yards away and he was going into the hospital too. He even counterflowed just to go ahead into the hospitals basement parking.
All of a sudden, I saw his wife and kids going down the car into the basement lobby! He still rolled down his window to give me his angry look.
Guess what I did?
I stopped my car beside his and I went down. He also went down and confronted me. I told him I was a doctor and he was in road rage. Told him to calm down and there was really no gitgitan that happened. He was insisting that ginitgit ko sya and Kasama pa raw nya wife and kids nya. He wanted to talk daw na Walang Tao. He was a big guy and for sure wanted to hit me. I stood my ground and said told him to relax and change his driving style. The guards approached and he left but before trying to screech his tires inside a hospital!!! Talked to the guards to monitor the guy and to guard my car too if he does something to it.
He looks like an educated guy with his whole family inside and yet he acted that way. I confronted him trying to clam him down and be quite friendly so that he knows that other motorists are not the kind he should be abrasive of.
Kaya rin pala he didn't roll down his back window entirely was because his kids were there!

To all tsikoteers, relax sa driving and we will all get to our destination naman. Hindi kelangan ng mayabang or mainis just because a car got ahead lang. If the guy is here in tsikot, hope you find peace when driving and I understand if you're on steroid rage, under drug influence, or marital problems. But next time, think of your family's safety before you get into the car and be a good example for your kids. Say a short prayer before driving. Peace guys

Get a dashcam. They're cheap and they don't lie. You'd be surprised how "asshole" drivers suddenly become very nice and apologetic when they learn you have one.

I feel sorry for the wife and kids. What a nightmare to have a douchebag for a husband/father. I won't be surprised if he becomes violent with his own family.

This person might look like he had an education but clearly has no values. He should practice patience MORE SO when he is with my family. What if he encountered a "Jason Ivler" He just put the lives of his family at risk. Kudos to you dr for your patience and taking the high road.

Ano pwedeng ikaso sa kanya and if matalo siya hindi ba papabayaran lang sa kanya yung damage which should be covered ng insurance? Wala naman siguro jail time yan? But still. Headache pa rin may kaso.

Not an expert on the issue, but kung ako nasa sitwasyon ni TS, since sabi naman nya may insurance sya, ipa-file ko na lang din sa insurance ko yung damage claim nung other party. Yun ay kung meron syang Property Damage cover. Wala naman participation fee yun, so walang dagdag gastos. Ang mangyayari nyan, maoobliga pa yung other party na dumaan sa process, since hihingian sila ng insurance company ng certificate of no claim, saka other pertinent papers. Kasuhan ka man nila, sasaluhin ka ng insurance company mo TS.
