Question lang guys, lets say may intruders sa house ninyo.

You kill them in self-defense, eh makakasuhan ka, baka makulong ka, human rights violator ka, tapos ikaw pa ang masama.

Pero kung ikaw ang pinatay ng intruders, eh wala lang, unless super sikat kang personality.

So what should one do?

1st things first, i'm not a lawyer. my reply is based on what i've read on the book entitled "the law on firearms and explosives" by atty.emmanuel topacio.

as stated on the book, previous court cases regarding robberies show that the home defender enjoys the benefit of doubt against armed intruder. (note on the word "armed").

however, in the cover of darkness during unholy hours, it is difficult to gauge if a thief is armed or not. imho, the best move is to shoot the BG once he attempts to attack you. basta wag lang nakatalikod because it would no longer meet the 3 criterias for self defense namely:

1. unlawful aggression
2. reasonable necessity of the means employed to prevent or repel it
3. lack of sufficient provocation on the part of the person defending himself

haha i remember the story of my ate's ex bf, may nahuli shang nagnanakaw sa backyard nila. Their dog did nothing kase super friendly pa nung dog (Labrador kase amp). Anyway, nabaril nya yung intruder, pero sa hita lang. Pag labas ng nanay nya pinagalitan daw sha tapos tinanong pa yung magnanakaw kung okay lang siya. Ahahahah Since lahat naman sila doctor sa pamilya ginamot nila bago ibigay sa pulis. haahaha natatawa lang ako kase pinagalitan sha sa harap nung magnanakaw bat daw nya binaril. I'm with 9MX on this one. As long as you acted in self-defense, and yo usatisfied the 3 criteria for a self-defense situation, then a competent lawyer should be able to keep you out of jail. Its not a human rights violation if its an act of self-defense.

Yes, there is a possibility that you may spend a night in jail, depende sa responding police yan kung mukhang grey area yung nangyaring incident. The cops may have to keep you in jail until they sort out the facts of the case, or they may allow you to post bail. What I recommend is, way before you act in self-defense, already contract the services of a lawyer whom you know to be good in trying cases such as these. Also, have a couple of hundred thousand pesos ready in case you have to post bail.

Ako, kinontrata ko na yung dati kong kasamahan sa shooting team namin na abogado, kaya hindi ko na inaalala yung legal quagmire na susunod... I'll have enough to worry about when someone is trying to kick down my door and I don't have the luxury of second-guessing if they just want my TV or if they want to massacre my family too just for kicks. You can't hesitate when your loved ones are in mortal danger.

If ever this happened to me, I wouldn't risk knowing if the intruder was armed or not. As long as he trespasses on my property, shoot to kill na. Tapos plant nalang ng deadly weapon sa kanya if ever wala. I don't want to risk the safety of my family or love ones just because of some fear of "human rights" violations. Kasalanan ng intruder na nagtrespass siya.

It proves na nakaikot na yun magnanakaw trying to find a way in. Ako nga lang ang nakarinig ng alarm ng kotse lahat ng members ng family was sound asleep. Pati mga kahol ng dogs hindi ko narinig. Bukas kasi aircon. Thanks for the alarm it's a big help! Nung walang makuha sa bahay kotse ang pinaginteresan

Sometimes, hindi rin effective ang dogs unless it is trained not to eat anything. Baka tapunan ng food na may lason.

I lived in Santolan, Pasig sa Maria Soledad Subdivision. That was in 80's. My Aunt still lives there. Paminsan-minsan, dumadalaw kami sa kanya.

I aggree with j avonni. Dapat trained na di kakain ng kung ano-anong pagkain na ibinabato sa dog mo. Have it trained by a professional. Medyo masakit sa bulsa pero it is worth it naman.
