    Kausapin nalang ang pamilya, ASAP, and arrive at an amicable settlement. Kahit di naman niya kasalanan, it's always good to clear your conscience by paying for the funeral.

    While, from your story, mukhang di naman siya malalagot pag umabot sa court case ito, considering lasing na tumatakbo ng bigla sa kalye yung namatay, malaking hassle at matagal matapos ang court case. Settling with the family will help settle the issue quickly.

    Kung may insurance ang sasakyan for Voluntary Third Party Liability, the accident must be reported immediately to the insurance company and let the adjuster do the negotiation with the relatives.

    Meantime, your friend shall be under the custody of the police until a bail is set and paid. Na-inquest na ba?

    Yan ang mahirap dito sa pinas. Sa tate, pag napatunayang it was an accident, innocent agad ang nakabangga after investigation (cyempre dadaan pa rin sa court). Dito sa pinas kasalanan mo man o hindi, kasalanan mo pa rin. Kakalungkot nman. Lalo na ito kapatid pa ng militar..koneksyon lang sa matataas na tao ang kailangan para mapatunayang guilty ang nakabangga.

    I would not suggest paying for anything. If a criminal case is filed against the driver, offering to settle the case with the relatives will be taken against him by the court. There are lots of cases like this where the act of paying for funeral, damages, even hospitalization, was (mis)construed as a sign of a guilty conscience.

    I agree with sir j_avonni that it should be the insurance who should do the talking. Your friend should just post bail as soon as possible then defend himself property before the prosecutor and/or the court.

    Malas lang talaga.

    sa pinas, bobo ang pulis at piskal: pag bangaan at may namatay, kinukulong yong driver sa kotse/van/truuck. reason: kasi may namatay, sa husgadoka na magpaliwanag. indi man lang maimbistiga ng maayos at pag-isipan mabuti kung may kaso ba talaga.

    sa kaso ng kaibigan mo: 50-50 chance niya. maaring makaiwas siya dahil lasing si pogi at tumatakbo (123 kako). pero kelangan niya ng medico legal showing high level of alcohol sa blood to prove alcohol intoxication, at mga testigo galing sa inuman to prove na nag-123 nga siya. on the other hand, yong friend mo guilty din kasi he was over-speeding at the time of the incident. at 70kmph, he was illegally.

    kung nasa open countryroad (with no blind corner) nangyari yon, puede pa kasi 80 kmph ang max speed. pero kung through street, 40 kmph; city/municipal street, 30 kmph; crowded street and approaching an intersection, 20 kmph. in other words, he was not excersing the proper deligence in driver his vehicle. pueding puede siyang makulong.

    suggestion lang po: ayusin ang kaso.

    Nangyari na to sakin before nung papauwe nako galing markina. i was cruising 60 km/h or less then out of the blue na bulaga ako me tumawid bigla umuulan pa nun pero na skid lang ang gulong nabanga ko sa directly sa gilid then umangat pa ata sa ere then kitang kita ko siya bumagsak sa hood ko. Nangyari nayupi ang hood ko then nasira foglmaps. this incident happen sa riverbank banda yung may mga squatters area going to c5 nako e. tumabi ako at hinuntuan ko di naman akokinabahan nangyari dami ng usi so yun dinala ko sa hospital sa may c5.. paid all the medical expenses the result, NO internal injuries bruises wala. iikang ikang lang. lasing din yun tao at mason ang trabho. grabe tibay ng katawan hehe gumastos lang ako ng 1K lhat lahat na yun.the sad part ang lake ng ginastos ko pagawa ng pickup ko na hood almost 5K kainis pero ok na yun atleast ok yung tao. then paglabas sa hospital nag ka pirmahan kame na wala nako pananagutan sa kabilang party at hindi na sila maghahabol sakin... then after a week nag text sila sakin asking for money pabili ng gamot etc... kesyo pag di daw ako nagbigay papa barangay daw ako hehe then i change my sim card for me ive done my part me kasalan din sila so dapat sila na bahala dun. ......

    honga naman, homicide agad ang kaso without any regard for the facts??

    shouldn't he only be charged if he was drunk himself or way over the speed limit? makes no sense.

    anyway, he should get a good lawyer asap...they should get toxicology tests to prove the dead guy was drunk, and get the bar owner/employees to testify that the guy just ran out on the street without warning....hopefully they'll be on your side because they were wronged by the guy also.

    and i also agree that any payouts should be through insurance. hopefully he didn't talk too much to anyone before getting legal counsel.

    mas kakampihan ng pulis yun nasaktan. naalala ko pang sabi ng pulis sa'min noon nakabundol ako: "hindi naman daw porkit lasing, eh babanggain ko na lang ng parang aso."

    he'll need a lawyer here. kasi after the settlement, meron dapat both parties na pirmahan na tapos na hanggang dun na lang.
