Pero dito sa atin, wala na tayong sidewalks, take over na ng mga squatters o ng mga vendors. 2nd, maski ang jaywalker pagnasagasaan, kasalanan pa rin ng kotse/driver. 3rd, kung mag surrender ka pa, there is no reduced liability to speak of. 4th, maski di mo kasalanan, ikaw pa rin ang magbabayad sa mga gastos, kasi pagdi ka nagcooperate, baka balikan ang pamilya mo. 5th, unless di mo type maging sikat, sigurado headline news ka lalo na ang driver is higher social class kaysa sa biktima. only in the pilipins!!

bakit? diba sabi sa philo, pagnagpapatay ka ang magkakaroon ng kasalanan yun pumatay at hindi ikaw... bakit kasi siay sumunod?
eh hindi naman kasalanan nun driver yun eh. eh kasi kung tumigil siya gugulpihin siya ng mga jologs na sabik sa away. peperahan lang siya dun at habulhabulin... peperahan ng pulis at ng nasagasaan. ang kalye sa kotse, ang sidewalk sa mga tao. hindi porke't nakuha ng mga squatters ang mga para sa tao na sidewalk eh kukunin ng mga pedestrian at ng mga skater ang kalye na para sa mga kotse. eh di dapat paalisin nila yun mga squatters.

That has always been a question to me. Talaga bang legal in the phils, for example sa highway mag nag jaywalk. Nabanga mo, ikaw ang at fault? Understandable ang ikaw ang magdala sa hospital, etc. Pero ano ba talaga ang legal liability doon? Any lawyers here?

oo sa pinas ikaw padin may kasalanan, although pwede kang mapawalang sala through your lawyer and kung may proof na sya ang mali, but not until na madetain ka sa kulungan while waiting for your lawyer, magbabail ka pa... labo no?

Pareho silang mali...Tsaka ang tigas naman nung nagskateboard na yun...Pero like I said pareho pa rin silang mali...Kawawa pa rin yung nakaskateboard dahil tao yun...Nakakatrauma yan mga ganyan...: (

pabaya naman kasi yung magulang ng batang iyon. kulang sila sa pangaral sa mga anak nila, tapos iiyak-iyak kapag napahamak ang mga anak nila. gabi na, nasa lansangan pa rin ang mga anak nila.

sana nga meron tayo strict rule na pag nasagasaan ka sa outside the pedestrian lane.. wala ng kasalanan yung driver..

personally, and here i assume that the skateboarder was doing his thing at a fair distance from away from the sidewalk, i think the skateboarder is at fault and the drivers have little fault in the matter. sino bang nagsabi na humaharurot? bystanders? such reports are often exagerrated. kahit naman hindi "officially" kumakarera yung dalawang SUV (racing 5000-pound trucks... hehehe), they would still have been traveling at a fast clip along the highway. but if the skateboarder was in the proper place on the road, then of course it would be the drivers' fault. this apparent moral non-accountability doesn't diminish what i feel were the drivers' responsibility to come to the aid of the stricken youth, however.
we have to admit that the law about drivers vs. pedestrians is really inane, however, and may give even a conscientious driver pause and make him run away in the irrational frenzy of the accident.
just like the jaywalkers in EDSA... in a perfect world, if i were to hit an idiot along EDSA, i would curse the idiot, bring him to a hospital, and then sue him or his family for damages to my vehicle. (youthful idealism on my part? perhaps)

seriously, i think our law should be updated so that motorists are not liable when you hit someone who is not in the right lane (pedestrian i mean)
