Reyes, Criminal Law I. if the mind is not criminal, the act is not criminal. but these things are not written in stone. if you dig deeper into criminal law, lack of malice is not a defense in special laws. but that is another story.

This is not the place to show off lawyer-ing. There is no impartial jury here, so I don't see why any conclusion has to be made.
If anything, the only jury here is the consensus of the majority. Malinaw naman sa first page palang, the majority find the Jaguar driver at fault.
There's nothing wrong with expressing a different opinion (regardless of how illogical the reasoning may be to other lay men). But not letting go of the issue and spending the past 5 pages in circles isn't helpful to anyone.
Let this serve as a Moderator's Warning - this thread is getting out of hand, and once it becomes nothing more than an avenue for mudslinging and circular argument, we'll close it.
Juan Martinez has made his point - he claims that the Jaguar driver did not maliciously try to counterflow or break the rules. He's made over a dozen posts defending his stand, and there's nothing wrong with that.
Everyone else disagrees, and that's fine as well. If his agreements will work with a judge, then great. Last I remember though, this was just an internet forum. Hardly any consensus is ever achieved here, especially on non-car topics.
So if his point is to convince everyone that his stand is valid, it ain't gonna happen. Likewise, the efforts of everyone else to get him to just agree with the common sentiment also isn't gonna happen. Stalemate.
You can argue all day long if you want, just keep it clean and avoid personal attacks. Oh, and sarcasm runs aplenty in threads like these - ang mapikon, talo.

^ anong proven to be true? you even commented to the effect na kung "indio" pa yung tao... anyway, you are entitled to believe what you want to believe. we were wrong to assume that he was rich and therefore he could have easily trifle our laws.
in the spirit of solidarity, let us have a truce here. no more recriminations, if any. and, mods, please, for the sake of posterity, do not close this thread. we shall pass this world only once. if we kick the bucket sooner or later, knock on wood, at least, we have something here that would last, if not forever, long after we've all gone. history be the judge.
after 35 pages of repeated arguments, i therefore conclude the following :
1. that the car with the dashcam counterflowed.
2. all this troubles could have been avoided if only he avoided going to BGC. (just like in saudi if other nationals meet an accident, the accident would not have happened if they didn't go to saudi).
*closing the thread doesn't mean it would disappear. it would just still remain in the annals of tsikot history
