    Ateneo player sued for drunken antics

    MANILA, Philippines - A basketball varsity player of the Ateneo de Manila University (ADMU) is facing charges and sanctions over a viral video that captured his supposed drunken antics in Quezon City early Sunday morning.

    Emmanuel Fernandez, director of ADMU’s university athletics office, confirmed that the man in the viral video – who claimed to be a councilor and challenged other motorists to a fistfight – is Blue Eagles player John Apacible.

    The video, first posted by Top Gear Philippines on its Facebook page, showed an apparently drunk Apacible introducing himself as a councilor to a motorist who confronted him over his behavior on the road.

    He was holding a “councilor” vanity plate, and challenged the person taking the video to a fistfight during the encounter.

    “In the Philippines, if you have a protocol plate, you’re allowed to drive drunk and do this for all to see,” the caption on the post by Top Gear Philippines read.

    The video showed policemen, who tried to intervene, allowing Apacible to drive away despite his apparent drunken state.

    Malicious mischief
    Businessman Ryan Bautista, who made the video, filed a malicious mischief case against Apacible after he found a dent on his car, said Superintendent Limuel Obon, commander of the Kamuning police station.

    Bautista, 37, of Dagat-Dagatan in Malabon, accused Apacible of kicking his red Honda sedan several times during the three-minute video.

    Bautista said he tried to stop Apacible as he was manhandling someone along Timog Avenue near Quezon Avenue at around midnight on Sunday, but the athlete turned on him.

    Obon said Bautista and Apacible were both invited to the police station to settle the issue, but the latter went inside his car and evaded the police officers.

    Cops under probe
    The policemen caught on video being cursed at by Apacible – Senior Police Officer 1 Jaime Morato and Police Officer 1 Randel Candelaria – were told to submit written reports on the incident, explaining what happened and what they had done.

    Obon said Morato and Candelaria will face administrative charges if they were found to have committed lapses in dealing with Apacible.

    Morato and Candelaria were patrolling the area when they saw the commotion, but refused to report the incident to the traffic department as it was not a traffic-related incident, he said.

    Obon said their fate will still depend on the recommendation of the Quezon City Police District’s Special Inspectorate and Legal Office and the decision of QCPD director Chief Superintendent Edgardo Tinio.

    He said the policemen are still reporting for duty since no complaint was filed against them.

    “They could not chase after him. They were not in a position to block him,” Obon said, adding that they were able to get the plate number of the black Ford Focus that Apacible used during the incident.

    Land Transportation Officer (LTO) records show that the Focus (ACA-7111) was registered to a certain Ronald Sitchon Lotoc of Caloocan City, but Obon said the vehicle was apparently given to Apacible as a gift.

    Despite Apacible’s behavior, the Kamuning police station will not file charges against him, Obon said, explaining that what Apacible did to the police officers was “part of the risks of the job.”

    PNP: No case yet vs ‘drunk’ Ateneo player | Inquirer News

    THE POLICE are still waiting for the man who accused Ateneo de Manila University (AdMU) basketball player John Apacible of kicking his car to formally file charges against him.
    In a video which went viral on Sunday, an apparently drunk Apacible—a member of the Ateneo Blue Eagles—hurled invectives at an unseen man believed to be taking the video, repeatedly challenging him to a fight while brandishing a “Councilor” vanity plate to prove his claim that he was a councilor.
    Supt. Limuel Obon, commander of the Quezon City Police District’s Kamuning station, said Tuesday that the altercation between Apacible and Ryan Bautista—a 37-year-old businessman from Malabon City—happened at 12:10 a.m. Sunday on Timog near Quezon Avenue in Quezon City.

    Bautista later went to the police station to file a complaint for malicious mischief against the AdMU player, saying his Honda car sustained dents after Apacible repeatedly kicked it.
    Obon said Bautista promised to return to file a formal case against Apacible.
    According to the police official, the altercation started when Bautista confronted Apacible for manhandling a delivery van driver.
    Obon said two of his men on patrol, SPO1 Jaime Morato and PO1 Randel Candelaria, chanced upon them and tried to intervene.
    The two policemen advised Apacible and Bautista to come with them to the police station to settle their argument but the Ateneo player made an excuse to get something from his black Ford (ACA-7111). However, he then sped off, Obon told the Inquirer.
    Under the Anti-Drunk and Drugged Driving Act, a law enforcement officer should conduct on the spot a sobriety test on a driver suspected to be drunk or drugged.
    Obon said the Special Inspectorate and Legal Office would conduct an investigation to determine if there were any lapses on the part of the responding policemen who were also asked to submit a written explanation.
    Asked to respond to criticisms about the police’s failure to take action on the incident, Philippine National Police spokesperson Chief Supt. Wilben Mayor acknowledged that while the “ideal situation” would be for law enforcers to arrest suspected criminal perpetrators, they would wait for an explanation from the Quezon City police.
    “We do not judge based on video, as technology today can be manipulated,” Mayor said. “Let us allow those on the ground and witnesses to give their statements,” he added as he called on them to come forward.
    The Ateneo University Athletics Office earlier said in a statement that Apacible “deeply regrets his reprehensible behavior and sincerely apologizes to all parties involved.”
    It also stressed that the school would deal with the “regrettable incident appropriately and swiftly.”

    Hoping ADMU will do the right thing...

    The Apacible incident illustrates what is wrong with the Philippines on so many levels.

    (1) Rude behaviour

    The way Apacible behaved was quite typical — a feeling of entitlement on the basis of his being related to a government official, and a quickness to resort to physical violence.

    (2) Toothless law enforcement

    Under Republic Act 10586, persons caught driving under the influence of alcohol are subject to severe penalties. This law was enacted on the 27th May 2013 but it was only this year “fully-enforced”. According to Section 6 of the Act; it is the duty of a law enforcement officer who suspects a person in violation of this law to “bring the driver to the nearest police station to be subjected to a drug screening test and, if necessary, a drug confirmatory test as mandated under Republic Act No. 9165.”

    Clearly, the police officers attending to Apacible did nothing of the sort. Just the same, Apacible’s behaviour could be interpretted as a “refusal to subject oneself to mandatory [alcohol and chemical] test” as stipulated in Section 8 of the Act which attracts punishment in the form of “confiscation and automatic revocation of his or her driver’s license, in addition to other penalties provided herein and/or other pertinent laws.”

    (3) Disproportionately light sanctions applied by the Ateneo de Manila University

    An official memo issued by the Ateneo on the 19th of October and signed by University Athletics Office Director Emmanuel Fernandez reads…

    It has come to our attention that John Apacible, a member of the Ateneo Blue Eagles, behaved in an unacceptable manner during an early Sunday morning encounter. John deeply regrets his reprehensible behavior and sincerely apologizes to all parties concerned. Rest assured that the Blue Eagles Team Management as well as the Loyola Schools will deal with this regrettable incident appropriately and swiftly.

    But a statement released by Blue Eagles Team Manager Epok Quimpo today alluded to disiplinary action not proportionate to the gravity of Apacible’s offenses to society…

    John made a mistake and it will not be tolerated. This is his own doing which will result to disciplinary actions:

    1) He will face game suspensions.
    2) He will not be allowed to practice.

    John apologized to the whole team including the coaching staff and management. His teammates will be supporting him through this trying time, more so in the faith that he will become a better Atenean. CURA PERSONALIS.

    But it wasn’t his team that was directly impacted by his behaviour. Where is the apology to the public?

    The Code of Discipline of the Ateneo is articulated in Section III of the Ateneo de Manila University Student Handbook (2102 Edition) and spells out the University’s expectations of how its students are to behave off campus…

    Students should bear in mind that any of their off-campus activities should not directly or indirectly tarnish the name of the school, especially in reference to the values and the principles it stands for.

    Furthermore;

    As a general principle, cases are considered major if any of the following conditions are present: against the laws of the land, endangering the life and safety of the members of the community, recidivistic, or against the core principles of the Ateneo de Manila University. Students can be suspended, dismissed or expelled for these reasons.

    Part IV, Item B of the Code of Discipline includes expulsion as one of the penalties for major offenses. In this light, Quimpo may have to re-evaluate his public statement and defer to due process as described in the Student Handbook.

    * * *

    This case will be a test of Philippine society’s resolve to live by the modern principle of rule of law. Filipinos should follow this case and remain vigilant and ensure that this incident is not reduced to another case of social privilege trumping the Law again.
