    Question lang: won't the deed of sale be deemed voidable in this case? Given that the nature of the signing is on the basis that the obligee was coerced?

    So kung ibinenta nga ng mga loko yung sasakyan, at nakita ng PNP for sale at inapproach yung nagbebenta, sabay sasabihin may DEED OF SALE ika nga, edi parang nagpahuli na rin ang loko? Tama ba?

    Also the owner's signature on the original CR must be the same on the deed of sale. Parang the deed of sale Modus Operandi is very questionable...

    it's not voidable even...it is void ab initio (void from the beginning). voidable contracts are those that are otherwise valid but due to some formal defects or non fulfillment of obligation, the contract may be voided; in this thread, the essential element of consent is wanting at the inception. lacking such element of consent there's no contract of sale, as sale is a consensual contract. when there's coercion and the car is taken by intimidation, kahit isang metro lang tinakbo niyan, carnapping na yan in contemplation of law.
