    the prosecution of the criminal cases is the call of the DOJ in general, Ombudsman when public officials are involved. in its prosecution the civil aspect is impliedly instituted, unless the private party, the car owner or insurance company (by right of subrogation-if i still remember it right) would prefer to prosecute the civil aspect of the case independently.

    the DOJ cannot set the bail higher than what the law has set. under the 2000 bail bond guide, kung walang force upon things or intimidation, the bail is set at P180,000; pag may intimidation or force upon things, 300,000; pag pinatay, non-bailable. in instances when the accused would be allowed to post bail, the prosecutor cannot set it higher than 180,000 or 300,000. the accused may file a motion to post bail lower what has been recommended. the prosecutor can only recommend. the judge has the final say if the accused be allowed to post bail or to post one lower than what the fiscal has recommended or to deny it.

    the judge, on the other hand, has to take into consideration Section 13 of Art. III of the 1987 Constituion (if my memory serves me right) that bail, as a general rule, is a matter of right. the accused may not be allowed to post bail provided, the two requirements are satisfied: 1. it is punishable by reclusion perpetua; and 2. the evidence of guilt is strong.

    i believe that prior to the Lozano, Sencil, and Evangelista gruesome murders, the gang's activities were limited to taking the car but not murdering the owner or the one in lawful possession of the car. hence, bail, as it should be, a matter of right.

    LTO chief tied to car theft


    MANILA, Philippines—Virginia Torres, chief of the Land Transportation Office (LTO), and 25 other LTO and police personnel are facing criminal and administrative charges for allegedly facilitating the registration of stolen vehicles, the Philippine Daily Inquirer has learned.

    A Feb. 2 report prepared by Chief Supt. Leonardo A. Espina, head of the Philippine National Police-Highway Patrol Group (PNP-HPG), showed that a criminal complaint was filed in the Department of Justice on May 7, 2009, against Torres in connection with the illegal registration of a Mitsubishi Pajero while she was the LTO head in Tarlac City.

    The charge against Torres, a shooting range buddy of President Benigno Aquino III who appointed her LTO chief in July last year, was for violation of Article 171 of the Revised Penal Code for falsification of a document by a public officer, according to the Espina report to PNP Director General Raul Bacalzo.

    The Inquirer secured a copy of the Espina report on Thursday. Phone calls to Torres on Sunday by the Inquirer were not returned although she released a statement earlier saying that the allegations against her were part of a “demolition job.”

    LTO spokesperson Roberto Ricohermoso declined immediate comment on the report, saying he had not seen it. The LTO previously said that the registration of the Pajero in Tarlac was done by a Torres predecessor.

    A copy of the Espina report was issued to reporters during a briefing at Camp Crame on Feb. 4, but it went unnoticed in the midst of an uproar over the killings of car dealers Venson Evangelista and Emerson Lozano, the arrests of leaders of a notorious car theft gang led by the brothers Roger and Raymond Dominguez and the alleged involvement of senior PNP officials in criminal activity.

    Star witness in Dominguez carjack case found dead in Cavite

    A key witness in a criminal case against suspected carjack gang leaders Raymond and Roger Dominguez was found dead in Cavite province over the weekend.

    A radio dzBB said witness Alfred Mendiola and two others were found dead in Salawag Village, Dasmariņas, Cavite on Sunday.

    One of the two other fatalities was identified as Angelo Miranda Herrera, who was allegedly Mendiola's boyfriend.

    The third victim was reportedly Herrera's uncle.

    The bodies were found tied up with cable while their faces were wrapped in masking tape.

    Mendiola was under the government's witness protection program. However, Justice Secretary Leila de Lima said Mendiola refused 24-hour security protection.

    Frightened

    Arsenio Evangelista, father of murdered car dealer Venson Evangelista, an alleged victim of the Dominguez brothers, said the murder of Mendiola and two others has frightened him.

    "Natatakot na ako," Arsenio said.

    Venson was allegedly abducted and killed by the carjack gang after taking his Land Cruiser.

    Arsenio said this was not the first time that a witness against the Dominguez brothers was murdered.

    Another witness, Cristina Rojas, was earlier gunned down shortly after attending a court hearing in Malolos City, he said.

    Witness protection

    Meanwhile, Arsenio questioned the WPP of the government.

    "Star witness mo, because hindi competent ang WPP, biglang makakawala (ang witness) tapos a few hours malalaman natin patay na. Anong implication nito, incompetent sila?" Arsenio asked.

    Arsenio said this was not the first time that Mendiola ran into trouble since becoming a star witness against the Dominguez brothers.

    "Last year nagpunta sila sa restaurant chain after attending a hearing sa Quezon City, biglang nawala, buti narecover siya," Arsenio said.

    Arsenio said Mendiola had preferred to be detained at the Malolos Jail in Bulacan but was returned to WPP custody after new intelligence reports indicated he was at risk.

    Before Mendiola died, he had made over 30 pages of testimonies before the court.

    The court had scheduled two hearings a month on the case of Arsenio's son Venson. - VVP, GMA News

    these killings only imply that "we" should be afraid. very afraid!
    yung mga galamay kumikilos pa. kailangang katayin na yung puno't dulo nito!
