Update!
Spoke with the nephew of the registered owner. According to Mr. Dante Bonifacio they sold it to a buy and sell with an open deed of sale. End of the story, they dont even have an acknowledgement from the dealer. They purchased a new SUV right after Ondoy and they needed to sell the Trooper immediately.

January 21st, 2010 10:05 AM #54eh sabi bumababa yun guy sa Civic to "explain" yun side niya doon sa Trooper...why would he do still do that? nakalagpas na diba...so if he just opted to just go on his way eh di tapos na. IMO hinde lang niya gusto mag explain but rather bumaba and wanted to confront yun Trooper. so the guy in Trooper just pull out his gun. mali pa if a guy went out his way after an altercation would you think na mag explain lang daw siya. come on.

I dont think that's the end of the story. Walang nagbebenta ng kotse (kahit open deed of sale pa ang bentahan), ng wala kang pinanghahawakan na identity nung bumili sa iyo. It is quite irresponsible of the previous owner to sell the car without anything to hold on to on who bought his car.
Eto na ang scenario. Open deed of sale, ginamit ang kotse sa kalokohan. Sino mananagot?. walang pinanghahawakan na nabenta ang kotse nung dating may ari. Patay ka. Ikaw ang liable. The burden of proof that the car is no longer in the possesion of the previous owner is now on him... tsk.tsk.. kaya ako, i make sure i have ids of the person buying my car and written proof na sya ang bumili.

well, with the picture of that a**hole all-over the place (internet forums, newspaper), madali na yan if the authorities will really have the will to haunt him down.

Gave an advice or two to the nephew of the owner. Here is their complete story based on our conversation. The Trooper was displayed outside their office in Marikina. A lot of dealers went until they really had to sell it immediately for only 500,000. The owner signed an open deed of sale with the dealer who just walked in. The dealer promised to come back with the notarized deed of sale when they get to sell it. Unfortunately, poor owner did not give any receipt at all. I asked them, "kahit mobile phone nung nakabili wala ka"? They answered on the negative. Lesson learned, never ever sell a vehicle without a copy of a contract or ID of the buyer.
Now the burden of proof lies with the previous owner. She has to establish the fact that she sold it. Otherwise, it will just be her word that she sold it.Last edited by fireblade; January 21st, 2010 at 02:27 PM.
