    CAMP PACIANO RIZAL, Philippines — A tricycle driver was killed and two of his four passengers injured when their vehicle was sideswiped by a Philippine National Railways train at a railroad crossing in Cabuyao, Laguna, early Thursday morning.

    Superintendent Arnel Gongona, Cabuyao police chief, said in a telephone interview that the Manila-bound train hit the driver’s side of the tricycle driven by Raul Ricamora as it was about to cross the railroad at around 5:30 a.m. in Barangay (village) Uno.

    The tricycle was thrown ten meters off the tracks, the police said.

    Ricamora died on the spot due to fractures and a head injury, while his passengers in the tricycle’s sidecar, Elena Quijano and June Hernandez, sustained bruises and abrasions and were rushed to the St. James Hospital in Cabuyao.

    According to witnesses, there were two other male passengers seated on the tricycle’s back ride but were able to save themselves after jumping off the tricycle seconds before the impact, the police said.

    Quijano and Hernandez, when interviewed by police, said they did not notice the approaching train.

    “But that seemed impossible for the driver because you would have heard a forthcoming train from a hundred meters,” Gongona said.

    He said the train did not stop after the collision. The police were coordinating with the PNR to identify the driver of the train, who is facing charges of reckless imprudence resulting in homicide.

    WTF? The police charging the train driver? Everyone knows that a multi-ton train will not stop on a dime even if you pull all the brakes on it. The tricycle had no place to be on the tracks of the train. The only one at fault here is the tricycle driver.

    wala din palang bantay at barrier yung intersection na yan.
    di tulad sa iba, aside from the barrier, may taga pnr pa, na magwa-warn sa mga motorists, na may oncoming train.
    yung "stop look & listen" sign nila, pundido pa yung pulang ilaw.......

    Nakita na nung namatay na merong parating na tren, pinilit pa din, salpok. Madaming witness ang magpapatunay dito. Sorry pero good riddance. Kahit papaano ang PNR natulong sa population control.

    Yung tren na nakasaga dun sa trike, yun din yung nakabangga ng puting Honda City sa Sta. Rosa City, Laguna nung January 31.

    Ito yung sabi ng Sta. Rosa PNP tsip noon:
    “When you are crossing a railroad track, stop, look and listen para maiwasan ang aksidente,” reminded Senior Superintendent Ismael Fernandez, chief of Sta. Rosa police.
    Hindi alam alam ng Cabuyao PNP Tsip ang R.A. 4136:

    REPUBLIC ACT No. 4136

    TRAFFIC RULES

    ARTICLE III
    Right of Way and Signals

    Section 42. Right of way.

    (d) The driver of a vehicle upon a highway shall bring to a full stop such vehicle before traversing any "through highway" or railroad crossing: Provided, That when it is apparent that no hazard exists, the vehicle may be slowed down to five miles per hour instead of bringing it to a full stop.
    Sa Metro Manila lang merong barrera at major RR crossings ang merong crossing keeper, kaya palala lang po: STOP, LOOK, and LISTEN

    in fairness it's not the police's fault actually, they really need to file the case, Kasi hinde naman sila Ang mag determine Kung may probable case or Wala eh, it's up to the fiscal office pero Sa ganyan case dismiss agad yan, Meron na ba kayo nabalitaan convicted na PNR driver dahil naka sagasa?

    Kailangan sundin ng police yun procedure, more so Meron namatay pag property damage lang hinde na ilagay sa kulingan yan but Meron Kasi namatay...

    Dapat baguhin Ang batas.

    anong kasalanan ng nag-mamaneho ng tren? bakit di sisihin ang PNR dahil nagkulang sila sa mga signals para malaman ng motorista na may tren na paparating

    o masakit mang tangapin, may kasalan yung nagmamaneho ng vios, nagmamadali siguro, nakakainis! bakit nangyayari pa mga ganitong bagay

    I think kailangan ng isama sa mga driving seminar ang railway safety (kung hindi pa kasama) pati dun sa seminar ng LTO. Many motorists wantonly disregard the STOP, LOOK, and LISTEN mantra.

    Sa lakas ng pagkaka*bangga ay halos nayu*pi ang kotse at nakaladkad pa ng ilang metro kung saan nahirapan ang mga rescue` team na maialis ang bangkay ng mag-ina mula sa sasakyan.

    I think the main issue here is finding out whether the train drivers used the proper signals or not.

    Several times I have come up to the train crossing near our place without hearing a single horn blast. Instead, the squatters at the side of the track are the ones signalling motorists to stop. One time, I was only fifty meters away when the train came blasting by. (some of these crossings are completely blind because of concrete fencing.)

    Which is strange, because I live two hundred meters away from the track, and the continuous blaring of the trains' air horns can be heard clearly through the night...

    If the train driver did not properly signal, then he is liable for homicide through negligence.

    Ang pagbalik ng comeback...

    Hmm... Good point Niky. In the tricycle's case, however, I would think he would've heard or noticed something before he crossed the tracks since he isn't cocooned by his vehicle.
