    short story:

yung OR po kasi ng sasakyan dito, kinuha ng sister-in-law ko. unfortunately, she passed away last week. laking problema po kasi, galit na galit yung family sa amin, kaya there is no way na masoli sa amin yung OR (with 2006 stickers actually). one of her sisters even said, naka hold daw po yung sasakyan!

    my questions are:

    1. pano kami magkakaron ulit ng OR and 2006 stickers nung sasakyan?

    2. pwede ba sila mag execute ng "hold order" (sorry, di ko alam exact term), knowing na hindi naman sila owner ng sasakyan and assuming that my sister-in-law did such a thing, now that she is dead, may effect pa ba yun?

Kanino naka pangalan yung car? Where's the original CR?

Hold order? Hind yata puede yan. AFAIK, kailangan may court order.
    Naka mortgage ba ang car?

pwede na ba namin gawin to ngayon?

sabi kasi sa LTO dati nung buhay pa sister-in-law ko, di raw pwede kasi hindi kami authorize na mag execute ng affidavit of loss kasi we are not the owner, bale and owner na raw yung sister-in-law ko (conjugal property).

sorry, di ko nabasa na di pala sa inyo nakapangalan yung vehicle.. well, yung heir na ng brother mo ang legal owner nung vehicle (which is the wife). since she passed away, sa mga anak na mapupunta ang ownership nun.

what if the son is still a minor? actually, he is only 8 years old and is living with the maternal grandparents right now (actually eto pa isa problema).

sino pwede mag execute nung affidavit of loss?

Hindi puede ang affidavit of loss. Patay na pala ang owner, and wife. If you want to do it the legal way, dapat transfer of ownership muna sa heirs, like anak. Kung wala it has to be determined by the courts.

Ibang paraan, meron....pero, no comment ako.

Have to apply for legal guardianship sa minor....again sa court. Oh boy, this is gonna be messy.

in the first place, paano napunta sa possesion ninyo yung vehicle, kasi nung mamatay ang utol mo, dapat ang sis in law mo may hawak nung nung buhay pa siya. wag ka sanang magalit sa akin bro, pero hindi kaya yan ang isang reason kaya galit ang family ng in-laws ng utol mo sa inyo? peace po tayo.

ang legal owner ng vehicle ngayon is the child of the registered owner of the vehicle, which is your nephew. you have to go to court to settle the guardianship of your nephew first.

you cannot execute an affidavit of loss since the owner of the vehicle is already dead. you may forge the signature of your brother if nobody in the LTO know him (or know he's dead), but since you are at odds with the in-laws of your brother, they might file a case of forgery against you.

baka the vehicle was actually owned by putalittlemore's family. maybe his brother just facilitated the purchase so he just used his name for easier processing of the docs.
