Peeps, need ur advice. Ganito po ung nangyari, nabangga ko ung crv pero i am not sure kung sino ang may fault. Sa my west ave..nag signal sign cya ng left at the middle of the road then i am sure kita nya na medyo mabilis ung takbo ko..But i made a half brake for that time pero parang stop cya, i thought he will let me go my way but he also move when i am already near to his car...Thats what happened nabunggo ko....I am asking po kung sino ung may fault and then about how much will i pay? Scratches lang kac baba malapit sa gulong.....Ung may ari pala chinese.....d nya gustong pumunta sa mmda or police..bad trip tlaga!

iirc, west ave is 2 lanes lang for each direction, for a total of 4.

where was the CRV? inner lane ng direction ninyong 2? if so, mejo tagilid ka na dun bro.

if he was in the outer lane...may laban ka pa kahit papano.

Both of us come from the right lane kac nung medyo malayo pa nakita ko cya lumiko tska nag left turn signal papuntang left lane kac hinatid nya yata ung mga kapatid nya sa may saint vincent school. Bad thing lang, nag stop cya and i thought free to go but nag move den cya..it happened sa gitna ng left and right lane....Ung tama sa side ng car pero nasa baba malapit sa gulong....

seems to me then na he was more wrong than you, kasi since he's about to do a u-turn or at least merge, he should've waited until the coast was clear.

although i could say as well na sana nabusinahan mo rin siya to warn him, just to be defensive. :D

could be a sign na alam nyang guilty sya. pilitin mo. sabihin mo kelangan mo sa insurance claim. hindi ka naman nagiging masama kasi this is the legal procedure.

reverse yung nangyari sa akin before. nabangga wife ko while making a u-turn. we offered to settle it without going to the police kasi feeling namin kami ang mali. pero sya ang namilit. so punta kami. turns out sa police report, sya ang may sala.

ung headlights ko then sa kanya sa baba lang malapit sa likod na gulong. He told me, he will bring the car to a auto shop to estimate how much will i pay him...Ok ba un?I am not sure pa nga eh kung cno ung may fault....Gee!

just to be sure, bring it to the police to have a blotter. meron naman diyan near the west ave area, sa baler station.

So whats the best advice po? dalhin ko nlang sa police or try to go for another shop to make sure?

bro.. imho... kung sa likod nya ikaw tumama, most likely, under normal circumstances, ang sasabihin dyan is ikaw talaga may kasalanan dahil for one, you could have taken steps so you will not hit him...

but again, as i've stated above, under normal circumstances yun ha? there could be other factors like, ki-nut ka, etc....

what i suggest you to do is just to pay yung deductible amount sa insurance nya, tapos patira na lang nya sa insurance nya.

ayaw niya magpa-police report para sa insurance claim purposes at malinawan who's fault ang accident. kung maluwag/OK sa iyo, offer him P2000, take it or leave it.
tell the other party, yun lang ang kaya mo.
tell him also, na kanya-kanyang paggawa na lang ng vehicle. kaya nga tayo nagpapa-insure ng vehicle yearly, diba?
extorsion na yan kapag nagde-demand siya ng pera from you.

the legal way to settle talaga is report the accident sa police traffic division and claim damages sa insurance company.


ano ang reason ng other party, bakit ayaw magpa-police report?
baka expired ang license nya?
carnap ba yung vehicle nya??
o baka wanted siya sa police???

IMO, it's your fault. Meron ka bang VTPL-PD insurance?

It doesn't matter who's fault it is. Just go get a police report about the incident. Be sure to write facts, not opinions about the accident. Advise the other party to do the same. Then let your insurance take care of it.

Good evening! Thanks mga pips sa advice. Away daw nya pumunta ng police kasi daw nangyari na sa kanya before na hiningi an daw cya ng malaki which is i dont know why....Well, i will take your advice people to bring this to a police department to make it sure kung sino ung may fault....At least may insurance nman un auto ko...thanks !
