    Customs: Import certificates for cars considered invalid

    The Bureau of Customs on Monday said that Certificates of Payment (CPs) transmitted to the Land Transportation Office (LTO) for purposes of registering imported motor vehicles are considered invalid as they contravene the provision of a Customs memorandum.


    As such, Deputy Commissioner Ray Allas said that these motor vehicles where their CPs were directly transmitted to the LTO may be subject to seizure proceedings as it is only the Vehicle Importation Compliance Monitoring Unit (Vicmu) under the Office of the Commissioner that is authorized to transmit them to the LTO.


    Allas said that it has come to the bureau’s attention that CPs for imported vehicles were being directly transmitted by some ports to the regional offices of the LTO for purposes of registration which prompted him to issue a memorandum to all district collectors reminding them of Customs Memorandum Order (CMO) 3-2004.


    Under the CMO, only the Vicmu is authorized to transmit CPs to the LTO for purposes of registering imported motor vehicles.


    “These motor vehicles may, therefore, be subject to seizure proceedings,” Allas pointed out.


    There are thousands of imported motor vehicles whose owners could not register them with the LTO because they have failed to pay the corresponding duties and taxes or that the duties and taxes paid were not correct as many of them were declared as mere spare parts or general merchandise.


    The government has offered amnesty to owners of these imported motor vehicles to pay what it described as tax deficiency on their imported motor vehicles to allow them to be registered with the LTO.


    The government also expects to earn an additional income of at least P5 billion from these tax deficient imported motor vehicles by offering amnesty to their owners so that they could register them with the LTO and avoid seizure proceedings as they could be deemed as smuggled.


    “Suffice it to state that violators shall be dealt with accordingly and that this office shall request the cancellation of the LTO registrations of the motor vehicles covered by such unauthorized CP transmittals and subject them to seizure proceedings,” Allas warned.
