Technical Description and Approved Lot Plan of Residential Property

Greetings!

Recently processed a property equity loan on a lot I own for a business venture. Requirements include the Technical Description and Approved Lot Plan of the lot which is in a residential subdivision in Laguna.

Would these two be something the regional LRA/RD in Laguna can provide or do I need to proceed to the head office? Not much use seeking help from the developer as they've already folded...

Technical description can be found in the TCT (e.g. 39.9 degrees northwest of avenue x, with.....) approved lot plan, per my understanding is the vicinity map showing the technical descriptiom signed and sealed by a geodetic engineer. Kung wala, you will pay to survey.

Bro, the approved lot plan you can get from 2 sources. One from the LRA, and one from HLURB if your developer was diligent enough to file one.

The others are right. The technical description is found in the TCT of the lot which you will use for collateral.

An update:

Made the trip to Calamba early morning Monday (it's been a while since I've been there, buti wala pa traffic!) and was at the LRA/RD by 8AM. Spoke with the Public Assistance officer and from the onset he noted "Ayaw siguro mag-sara yung technical description?", to which I said I am not sure.

For the requirements, he referred me to the Land Management Bureau (LMB) of the DENR and sure enough, they validated that there was indeed a problem with the technical description on the title - simply put, there were two points in the lot's description which did not meet to mark a clearly delineated piece of land. They will be checking their records and will be providing the required documents and plans (including those of the four other lots bordering mine, for reference) by Monday next week. Aside from being used for the loan requirements, I can also use these as reference for annotations to my TCT to be updated at the LRA/RD.

Good thing that I found this (discrepancy) out earlier. From the looks of it, it is not a very uncommon thing to happen. I'm now sharing the experience with friends who are looking at their TCTs as well for potential discrepancies. The lady at the LMB glanced at the description for ten seconds and was easily able to detect the error, so I'm thinking an Architect, CE, or GE would be easily able to see if there is an error in the document.

Not a simple problem though. You have to file for petition with the concerned registry of deeds for correction of technical descriptions which will require court hearing(s). And we know pretty well the rigmarole in the bureaucracy.. goodluck..

Oh yes, that will be owner's problem. For due diligence, the correction of the title's TD should be required prior to granting of loan to the proponent.

Who will do the Approved Location Plans/Survey Plans (signed and sealed by Geodetic Engr) required by the City Engineers Office.

It's a residential subdivision lot, do I need to have this included with the building plans maker, Or is this available with the developer?

I have seen a sample of a location plan, which is basically the lot drawn based on the tech description from the title. Is this it, simply signed by the Geo Engr?

or is an actual survey needed and approved (by who?)

Better kung may actual na survey para ma check mo na din yung property. Pero kung plan lang talaga kailangan mo, pwedeng pagawa ka lang sa GE.

Location plan is where your lot located and lot plan/survey plan is done by your GE based on land title you provide. Subdivision developer only provide lot plan of whole subdivision with lot numbers. So if you have your lot relocated your GE will provide you lot plan with sign and seal

Thanks Sirs Robot and Max, so ito nga yung nakita ko sa internet na kinukuha lang sa title ang tech description at lalagyan ng drawing, compliance lang naman to secure building permit. Tinuro naman sa akin ng turn-over assistant yung marker ng lote, simpleng pintura sa pader hehe... anyway sinukat ko naman yung dalawang empty lot, sakto sa sukat na binili ko.

Btw, yung approval siguro na tinutukoy dito ay yung sa developer siguro manggagaling since sila mag pre-approve ng plans before getting permits
