G.R. No. 96452

Kung pagkakatiwalaan nyo ang company na ganyan mag deny ng claim ewan na lang. but in fairness to perla matagal na yung kaso na yun baka naman nag bago na???
I think I remember, the claim was denied by the insurance co. For unauthorized driver clause.
Under repair or service ang car sa isang CASA.

    Tama ginawa nila.

They denied the own damage claim on the basis of driver clause.
The court ruled that indeed the driver was unauthorized.
But under theft section the claim is valid because the damage was done
while in the possession of the thief. The thief being the mechanic of the CASA.
Meaning the /THEFT section of the policy is in force.

What is the effect of this?
The insurance pays for the repair or total loss.
Then they will recover from the CASA the cost of settlement.
Because the car was entrusted to the CASA, a customer.
And was stolen by an employee of th e CASA.

The CASA then claims against their own Fidelity Insurance to pay
for the claim of Perla Seguros.

Maayos yan Perla Seguro, sa trucks sila kilala. Ngayon.

car and ultimately the financial liability.

-iba pa pala na case na basa ko.

So if the same incident happens again mas mabilis na dapat
ang claim dahil may precedent na.

^ I think the "joyride" case is different from the one im referring to sir pero yang joyride nga ang mas popular sa subject ng theft at driver clause. di ko lang matandaan kung perla involved dun.

Maybe may goodwill ding na establish kahit paano yang name ng perla for the company to keep it after so many years.

I have a terrible experience with them, na carnap pick-up ko which is less than a year old. Halos inabot ako ng 2yrs even went to as far as insurance commision and when they finally paid ang binigay saakin halaga ay yung running price ng 2nd hand 3yr old pickup. kinuha ko na din dahil magtatagal pa ang kaso or papalitan lang ng pickup na same year model.

Seguro in spanish means insurance (or assurance). Seguros, means they offer more than one type.
    (a)segurados means insured/assured.

Perla compania de seguros (Pearl insurance company)

    vs

Thanks guys for the responses! And yes, matagal akong lurker. Since 2009 pa, I was planning to buy a car back then pero di natuloy.
Pero now, I just got my first car, a Hyundai Accent and I got the insurance from UCPB where I have my loan.

Binasa ko ung profile nila sa website and it seems sila nga yung Perla Compaņia de Seguros, Inc.:
"Perla Compaņia de Seguros, Inc. was incorporated in 1963 and has its Corporate Headquarters at the Second Floor of Perla Mansion, 117 Carlos Palanca Street, Legaspi Village, Makati City. We have established sixteen other branches to service our clientele throughout the country."

I tried researching for feedback sa kanila pero wala talaga ako makita. And based on your responses, mukhang wala masyadong nakakakilala sa kanila. Nakakapagtaka din kasi the website says they've been operating for 44 years.

Anyway, possible pa kayang mabawi ito and lipat to other insurance companies? Although, I think I already know the answer to this.
