    I need advise kc nkasagi ako ng RAV4, just a minor scratch lng nmn, unfortunately wala akong insurance, kinuha lng ng nabagga q ung photocopy ng licence and registration q alang police report na naganap. Tinawagan q xa sa ofc and asking for 24thou which is overkill kc minor as in minor scratch lng tlg. So dinedma q, until today I receive a letter from Malayan Insurance stating na na hit and bumped q nga un RAV4 then asking for settlement out of court. Question di ba d pde mgclaim pag alang police report unless hit and run? posible bang pineperahan aq ni Malayan kc nung tumawag aq sabe q sbra ang hinihingi nilang pera sken 24k then inemphasize q na alang police report so gawa n lng daw aq ng letter and kung mgkno maibibigay q.. What should I do? Pde bang ignore ko na lng?

    Posibleng yung ahente at yung may ari ng sasakyan ang magkasabwat. May mga pictures ka ba nung aksidente?

    btt: probably that 24k covers all the repairs that needs to be done dun sa RAV but necessarily caused by the accident. Since walang police report, i think may usapan na yung Insurance agent at yung owner (baka may lagayan para ma-include sa claim other repairs needed).

    Ang masama, wala man lang picture of the damage created ng accident. walang basis. they could claim na extensive ang damage. Your word against theirs.

    Please refrain from text speak in the forums.

    That being said, you should get a lawyer to reply to the letter sent to you by Malayan, denying their claim for compensation. Just tell your lawyer what happened and he'll take care of drafting and sending the letter.

    Dedma mo na lang yung insurance, just talk to the other party directly.

    Tell him you would have his RAV4 repainted at Toyota, Toyota Makati is offering 1 day repainting, I think it was P2,500/panel. Bilangin mo na lang kung ilang panel yung nagasgas sa Rav4 at yun lang ang babayaran mo.

    Mukhang papayag naman siguro yung other party if the repainting is to be done at Toyota. And hindi na kailangan nung other party to pay participation fee sa insurance. Go for settlement na lang and have him sign for quit claim.

    You should not have left the scene of the accident without any agreement or setlement, charge this to experience. I agree that the 24k he's asking is way to high if you said there's a minimal scratch on his ride. Get a lawyer to help you on this.

    yun minimal na damage..relative ito...pwedeng minimal saiyo pero sa owner ng RAV4 eh grabe...laya nga dapat mern kang evidence (pics, affidavit, police report, etc)

    if you really think that it's too much, you can tell the owner of the RAV4 to go to toyota and have a quote and show you the quote .. or mas maganda pa samahan mo siya ..

    *ryan loredo - are you sure the letter is really from malayan insurance? kung maliit lang ang damage, lets say 1 panel lang ang affected then more or less 2,500 lang ang cost of repair nyan. from that amount hindi sasagutin yan ng malayan insurance. im sure mayroon yang "deductible amount". sa akin deductible amount ko eh around 6,500. anything equal or lower than that ako na ang sasagot. In the event na mas mataas ang damage then less lang yung deductible amount sa cost of damage then yun lang ang sasagutin ng insurance.

    baka tinatakot ka lang nung owner? talk to the owner then punta kayo sa repair shop for estimate and have it repaired.

    Repair shop na accredited nung insurance ng nabangga mo.

    di ko masyado nasundan yung sinabi ng TS dahil nga sa text language na super haba. Nakakahilo.

    Malayan really is an aggressive insurance firm. I can personally attest to that several times. My insurance is not Malayan, yung kabilang party ang naka Malayan. In your case, most probably since it is Malayan who is running after you and the the owner, most probably the owner already claimed it against his OD. Which means without any clear police report, any pictures, or anything to prove that was the damaged part, then the owner could easily claim anything he wants. Kaya siguro umabot na yan ng 24K.

    What are your options: Either admit to the accident, but vehemently deny that the damage was that extensive; you gave your driver's license and OR/CR copy but that does not mean admitting fault. Pwede mo lusutan ng ganun, kasi wala naman kayong pinirmahan na who admitted fault, na parang police report. 3rd, the other party cannot claim hit and run (sa sinabi mo, wala naman ang hit and run sa scenario), kasi kung hit and run, paano niya nahawakan ang photocopy ng lisensya mo, obviously na photocopy niya kasi binigay mo ang lisensya.

    Ang style kasi ng mga agresibong insurance kagaya ng Malayan, hahabol talaga, whether sure thing or hindi. Kagaya ng situation mo, obviously it is not a clear case for the other party, kasi wala naman siyang hawak na kasulatan na umamin ka sa nangyari, wala ring police report. Kaya hahabol na lang siya. If you blink, happy ang malayan. Up to you to react.

    Their business is risk assumption, why would they transfer their risk to you?

    Hit and run? If they go for that then you can send them to jail for perjury.
    But wait for the charges and affidavits.

    i've always used malayan to insure my cars and i've always had good service as the insured .. i don't know how it is on the other side pag-ikaw na yung hinahabol, though .. that's why i agree with yung mga suggestions ng mga tao dito na you don't take the 24K at face value and request for an itemized report and even when you get that, have it validated pa rin .. i've been through more insurance claims than i want to ..
