but it might put a red spot on bossing's credit rating. that alone, should make your boss hop to it.

Yeah you're not telling us something. No bank will release a car without all the checks being written out to it in advance.
And the bank never tried to contact him in advance? Before this legal letter arrived? Banks dont work that way. You can be assured they will call you looooong before it gets to this legal stage. Its very hard to believe your story.

Since they have 2 years worth of untouched car payments, that's a huge chunk to give to the bank na rin. Mag negotiate na lang baka pwede bawasan penalties.

EQ's point is about your boss not knowing that the checks have not cleared. 1 year worth of PDCs that did not clear the bank is substantial enough not to be noticed. I am guessing the total would be around P150k to P200k so your boss should have noticed it unless there are millions in the bank and your boss is not tracking his balance. Anyways, try to negotiate and show good faith that your boss is willing to pay the balance through loan restructuring. Good luck.

if you have documentation that proves that the bank has the pdcs, you can show that bank the document, to prove to them that it's actually their fault...
unless!!! someone closed that account...! and the bank can't contact the boss, because the boss'es last-known address is the old one...
