As suggested, you offer first to pay for the participation not the whole repair. But the Trail owner has to inform his insurance its a own damage, otherwise the insurance will still go after you for the entire cost of the repair. If he doesn't agree, insist that you will pay for the entire cost if the repair is to be done at the talyer of your choice. Tell them thats only what you can afford. But before that, just make sure that the outside repair is significantly lower than the 58k they are asking, at least 50% cheaper.

basta maayos kang makiusap ay pagbibigyan ka ng TBZ owner na i-claim nya as own damage (of course yung participation at konting cost ng abala ay huwag kalimutan).
not sure though if this is still the case if TBZ owner has already reported this incident to the insurance provider.

If ikaw at fault and stated sa report kahit ipasok sa insurance yan participation lang payables ni TBZ owner pero ikaw hahabulin ni insurance for the rest of the expenses.
Agree also na if ayaw ni ipagawa sa labas, wala ka magagawa. Hindi naman niya ginusto na banggain mo siya eh. Sadly the owner will call the shots.
Talk to the owner, hopefully they would consider na claim as own damage na lang. pay the participation and again like what I said, dagdagan mo na lang para dun sa abala na ginawa mo.

August 6th, 2017 05:04 AM #17No police report kami kasi we all wanted amicable settlement. Meron lang kami from the guards stating na ako naman talaga ang at-fault.
For now, nakapagpa-estimate pa lang siya sa Chevrolet CASA. Sinend niya sa aking yung quote which is 58k nga lahat. She is demanding 50% na so that the CASA can order the parts already daw.

are they newbies in insurance claiming? i see no logic in not using their insurance now, because that is precisely what it is for.

IMO, if the Chevy uses her own insurance... Pwede din kaso mahabang paki usapan yun. Let's not forget, binangga mo new car nya so di lang sya galit syo... Pati friends and family nya.
Kung may kilala kang lawyer, I suggest na kausapin mo sya to see kung anong options mo...
