    Hi Sirs and Mesdames,

    My GF was driving this morning on her way to Review School when, turning left in an intersection (SH Loyola something), an L300FB touched the left 2nd row door of her car.

    Since she was in a hurry, she didn't wait for a Policeman to get a Police report (but i was told earlier this can/should be done within 72hrs - is this true?).

    I arranged a meeting this afternoon with the L3 driver and i took pics of him and his vehicle. He is asking 3,500 for the damages for his vehicle. If he's not the one at fault, where can we have his vehicle repaired cheap and good within Metro Manila?

    If you just need a not so expensive shop, try calling Jay Remo 09276016133 . Tell him 'Ki' reffered you to him. Diyan ko pinagawa yung Starex before. Full bumper repaint (bullbar and main bumper), less than Php2,000.00 ang singil sa akin and maganda ang gawa. Unfortunately, nabangga ng bus yung Starex two Saturdays ago.

    Yung shop nila nasa dulo ng Araneta Ave. (halos likod ng SM Centerpoint).

    You can try getting in touch with Jan Oliver Go at 09189424386. Tell him I reffered you to him. His shop is near Banawe. Not sure how low he will go pero hindi naman siguro taga.

    was it established na your GF was at fault?

    di ba comprehensive ang insurance ng car ng GF mo? let the insurance handle the FB if it was really your GF who's at fault.

    Hindi kaya malugi pa si HP sa insurance kung dun pa niya pagagawa yung L300 (assuming his side is at fault)? Mukhang wala pa sa minimun ng participation yung total damages. Kaya hindi ko na pinadaan sa insurance yung Starex dati. Minimum is around Php5,000 ata. After ko makipagtawaran parang Php1,500.00 na lang hiningi ng pintor sakin (all-in na). Hindi ko maalala exact amount.

    Pero yung estimate sa latest crash ng Starex was Php50,000.00 (typical exaggerated casa estimate). Umabot naman na sa minimum, pwede na insurance. hehehe.

    there's no participation in claiming for third party liability. own damage lang may participation.

    so kung papagawa po namin yung L300 dun sa insurance, wala kaming babayaran kahit ano?

    *OTEP: sorry sir, cellphone cam lang po dala ko e. hehe. Thanks a lot for the referral. sabi nung L3 driver, 2000 pesos daw yung right signal light assembly ng L3 (nagcrack po kasi). totoo po kaya ito? parang ang mahal e.

    *Boybi: Sir, actually nagtuturuan po sila. The driver is blaming my gf and my gf is blaming the driver. The driver is claming that, he was signalling that he is going straight (not sure how he's doing it broad daylight and on a red signal). He claims that my girl probably didn't see him which is kinda weird because he's on a "stop" status when my gf turned left. My hunch is that, the L3 driver accidentally or intentionally moved forward when the santafe was making the turn (thus damaging only the 2nd row door). Im not sure about that since im not an expert on these things so i thought of creating a thread to be viewed by those who are more experienced and thus come to a better-thought decision.

    Hindi ko alam ang presyo ng signal light ng L300. Pero madami naman sa Banawe niyan. Yung metal at paintworks mura lang yun.

    Tawagan mo si Tita Puring sa 02 4100954 at itanong mo presyo nung ilaw. May tindahan siya sa Banawe (small lang). Pasensya na at hindi talaga ako naglalapit sa mga 'branded' na lugar. hehehe. Kilala naman niya ko as 'Otep'. Andun ako nung Sunday getting the battery tie down for the Vitara and kanina getting some lubricants for the Benz.

    Wala ako sa scene, pero mukhang (mukha lang) your Sta. Fe clipped the L300 based dun sa progression ng damage on both vehicles. Of course, other factors could be at play.

    As with the damage, the casa estimated 6k++ on the SantaFe. Rustproofing, welding, disassembly etc (yun po natatandaan ko don sa quotation).

    IIRC, 0.5% po ata which means about 8k yung participation sa insurance (AFAIK with TPL ) pero initially parang 5,500 lang eh, check ko po tom with the agent to be sure.

    Php6k yung estimate pero Php8k ang magiging participation mo? Diba percentage lang ng estimate ang participation? Sensya na sa tanong, bihira ako gumamit ng insurance.

    Kung Php8k ang cash out mo, medyo lugi ka na. Standard market price ng crash repair is Php3k per panel. Since yung isang panel (after the door) ay maliit lang, patatawarin ka pa ng shop (if they know na out-of-pocket) mo babayaran.

    Saka wala nang welding iyan kasi single wall lang ang pinto. They can reach it from the other side by taking out the door panel.

    would you be able to post a diagram or rough sketch on where the 2 vehicles were, lane-wise, at the time that the accident happened?

    ay kamote. phobia nako sa mga L300fb drivers na yan. binangga ako dati, clearly na siya mali, pinagpilitan nila na otherwise. took 2 years and umabot pa sa court of appeals pero based talaga sa lahat ng evidence, wala silang laban. when i got the check to pay the damage sa lancer ko dati, matagal nang nabenta yung car at napaayos yung damage, and i wanted to burn the check kasi the legal costs were about 4x as much.

    ginamit na lang ng mom ko yung check to treat church friends and relatives sa breakfast-all-you-can sa something fishy sa eastwood.

    Having had to attend to a quite a number of crashes (we never call them 'accidents') and basing only on the photos (sayang walang wide shot, bakit puro close up?), it is still possible that the Sta Fe clipped the L300.

    1. When someone clips another vehicle (nasobrahan ng pihit sa manibela) out of their line of sight (e.g. your gf clippng the L300), they tend not to stop immediately since drivers tend to only start braking after the impact has occured since they did not actually witness the clipping to have occured and will only start to brake after impact is felt. Some drivers don't even brake.

    2. If the L300 made first contact, the tendency would be for the driver to swerve in the opposite direction (away from the Sta. Fe) in the interest of self preservation (never mind his vehicle). And this happens almost instantaneously since the other vehicle is in his line of sight. This usually results in a shorter gash line on the other vehicle (especially when taking into account the slow pace of vehicle in the area of the crash) and can even result to the driver of the L300 hitting the vehicle on his opposite side.

    Again, this is just based on what little evidence we have to work with here.

    based purely on the pictures you provided, your description of the incident seems correct and that it appears that the FB was the one who hit the Sta Fe basing on the damages incurred. Should you re-enact the incident, your GF already entered into the cross-lane of the FB when the FB hit the Sta Fe, which explains why the damage on the Sta Fe is on the left rear door side while that on the FB is on the front left corner of the bumper..

    eh, ang alam kong madalas na katwiran sa atin "kapag walang witness o police report" ay kung sino ang bumangga ay siyang lumalabas na meron kasalanan.. so in this case, judging simply on the pictures and barring any other accounts, yung FB ang lumalabas na meron kasalanan..

    i could very well be wrong though... my two cents..

    uhm... paano ba magsignal if you're going straight..

    my personal view on who's at fault;
    25% - your GF - baka di nya natantya yung liko coz of the wide body of santa fe..
    75% - L300 driver - he may be inching forward kaya nasabi nya na he's signalling na didiretso sya..

    My GF has decided to just have the L300 fixed regardless of who was at fault para at least, wala na syang problem or iniisip na naka-perjuicio daw sya. We're gonna use the TPL of the insurance. Wala palang babayaran pag Third Party. hehehe.

    At least we can use the Insurance, 40k din kasi yun annually.

    Is it a good idea? would there be any bad implications (for her) in this decision of hers?
