Procedure of Change of Ownership

Mga pare, need help sa situation ko:

I bought a second hand car last July 2006, bale 3rd owner na ako. Up to now hindi ko pa napapa-change ownership yung car dahil sa problema sa CR. Yung homebase ng car ay sa LTO Pasig. Nung binenta sa 2nd owner, pina-change ownership at rehistro sa LTO Subic. Yung CR na binigay sa akin ng 2nd owner, issued by Subic pero ang hmb file nya nasa Pasig. Parang na-rehistro sya sa Subic by the 2nd owner ng walang clearance from Pasig. Ano ang dapat ko gawin?

Hi! This is my first time to join a conversation. I have a question. What's the process in changing of ownership if the original owner is already deceased? My mom gave me a car 7 yrs ago, she died 4 yrs ago. It is registered under her name. I am the only one using the car. All the original papers with me. I renewed the registration for the last 3 yrs still under my moms name. I have not yet renewed the car this year. Due date was last July. I have 4 siblings, all legal age ( 1 is married, 1 single and 2 separated). How do I go about it? Will it be sufficient enough if my brothers and sisters sign a notorized affidavit of waiver of rights, that they allow the change ownership under my name? Do I have to renew the registration first before change of ownership? How much will it cost me? I do not want to deal with a fixer, will it be difficult?

Mga bossing ask lang po ng friend ko,mya nabili kase syang 2nd hand car 2 yrs ago,since then hindi pa nya na-transfer sa name nya,bale po 4th owner na sya,may multa po ba yon pag pina-transfer na nya under his name?

paano yun? pwde ko na lang ba isabay ang transfer of ownership sa next registration next year? pwde na ba yun na proof na hindi carnap siya kasi he was able to renew its registration already? or should i still go to the tmg/lto to verify? pwde na ba ang dala ay or/cr lang hindi na ang car? or pwde ba siya ang magsign sa deed of sale tapos gawa kami ng bago na DOS na sa katunayan ay sa kanya ko binili? hindi kaya magkaproblema yun if dalwa dala ko DOS sa next registration? sori for much questions but i really dont know whats the best thing to do..thanks

this normally happends (the open deed of sale stuff). my opinion is even though he has registered his car, its not a concrete proof that you are buying a safe car. it can still be a hot car. you should verify first with the TMG to see if the car that you are planning to buy is not a hot car.

yung transfer of ownership, as i've previously mentioned is not required with the registration process. but for your convenience, you may do so both.

pwede yung i-sign mo is yung open deed of sale, but i would recommend that you should also sign something with the second owner as a proof that you have bought the vehicle from him.

hindi magkakaproblema yun in terms of change of ownership dahil ang hihingiin ng LTO is the deed of sale (which is the open one), between the original owner and you. kailangan mo lang nung second deed of sale between the second owner and you for your protection.

afaik, walang multa. i have known owners of second hand cars who did not have their ownerships placed under their name dahil umiiwas dun sa chattel mortgage fees na iniimplement nung dating company ko.

hindi naman kailangang sabay ang registration and change of ownership.
although it will be more convenient for you kung isang lakaran na lang.

since the original CR is in pampanga, you may siguro fix that at the LTO Main Office in Diliman (East Avenue).

my issue po is when i have it notarized (DOS between the orig owner & me), the lawyer is asking pa some documents from the original owner like secretary's certificate since nakalagay kasi sa OR/CR nya is the orig owner's name c/o a certain company, otherwise the lawyer cannot execute daw the notarization.
my question is, can't they notarized it ba tlga since i'm still waiting pa kasi for the secretary's certificate from the orig owner to arrive? ganon po ba tlga kahigpit kahit sa notary ngayon na parang sa LTO ko na sinasubmit ung mga documents ko?

any thoughts guys? TIA

if the car is owned by a company, definitely you would need a secretary's certificate to go with the deed of sale. hahanapin talaga yan during notarization.

ah i see. right now, i've driven the car quiet a number of times na rin since i acquired it 2 weeks ago armed with the DOS from the supposed to be 2nd owner, OR/CR named after the orig owner & xerox id's. sa ngayon po kasi, hndi ko pa muna fini-fill up yung open DOS coming from the orig owner as i'm still waiting pa for the sec certificate to arrive, but i always have it all with me every time i drive. if ever i get apprehended, will i be held in question for this? wala bang bisa ang isang DOS if it's not notarized? (well at least, for the purpose if ever i get flagged by traffic authorities, just in case lang nman)

what can you suggest po kaya?

Hi good day! May same problem po ako, may car kame gusto na namin ibenta 1st owner kaso nakapangalan pa sya sa father ko (deceased) possible kaya na mabenta namin sya kahit sa kanya pa naka-name? Nka-register yun car sa Lipa Batangasa and i live in QC.. If ever po na itransfer namin sya sa name ko pwede ba sya ma-process kahit saan malapit ng LTO branch? or kung possible nga na mabenta namin sya kahit hinde na namin itransfer sa name namin? i heard na marami po requirements kapag itransfer sya sa name ko.. Please advise po maraming salamat!

Sabi nya wala na siyang contact dun sa isang nakapangalan sa OR/CR so hindi kami makakakuha ng ID and signature nun.. yes. an affidavit signed by all of your siblings and your pop is required + death certificate of the original owner.

you may renew the registration first and then just go back for the change of ownership. what is important is that you have to renew the registration first dahil huhulihin ka ng LTO pag hindi registered ang sasakyan mo.

the cost is around 3000, pero sobra na yun. it excludes cost of registration.

huh? na-rehistro sa subic ng walang clearance sa pasig? LTO talaga oh. hehehehe.

anyway, since the original owner has it in pasig, i assume that the papers are still in pasig, so you can go there to fix this out.

ensure na dala mo yung DOS from the original owner to the second owner and the DOS between the second owner and you, chaka yung original OR/CR coming in from the second owner.
