Should You Surrender Your Driver’s License?
We got a reaction from one of our readers, Mr. Marianito P. Zarsadias, regarding the correct and proper procedures that MMDA traffic enforcers should observe during apprehension for a traffic violation, which we published some weeks back on this column specifically on the matter of surrendering one’s driver’s license.

"Two cases decided by the Supreme Court, i.e., Metropolitan Traffic Command West Traffic District, petitioner, vs. Hon. Arsenio M. Gonong, in his capacity as Presiding Judge of the RTC, Br. 8, Manila and Dante S. David, respondents, G.R. No. 91023, July 13, 1990 and Solicitor General vs. Metropolitan Manila Authority. G.R. No. 102782, Dec. 11, 1991 have declared that confiscation of driver’s licenses and removal of license plates for traffic violations within Metro Manila are illegal and cannot be done."

I have asked my staff to research on this and find out if there has been any ruling that had rescinded the above-mentioned, considering that the confiscation of driver’s licenses is being done during apprehension for traffic violation while substituting such with a TVR or a Traffic Violation Receipt.

alam ko yung plates lang yung bawal iconfiscate... pero kung di rin pwede yung license... mas ok!

hmm.. ano ba talaga?.. alam ko ang plates kinoconfiscate usually pag may violation about the car.. like smoke belching.

tapos ang mmda ang dalas pa kunin yung card mismo na license...

sana maliwanagan naman tayo kung ano ba talaga ang dapat!..
