    SECTION 5. Repair Attempts. - At any time within the Lemon Law rights periods and after at least four (4) separate repair attempts by the .same manufacturer, distributor, authorized dealer or retailer for the same complaint, and the non-conformity issue remains unresolved, the consumer, may invoke his rights wider this Act. The repair may include replacement of parts, components, or assemblies.

    It's law already according to Sen. Bam Aquino :-) But don't take my word for it. :-) Palagay ko naman hindi na i veto ito ni Pnoy.

    for brand new cars nga lang itong SB 2211 (Villar, Estrada-Ejercito, Aquino).

    i wonder what happened to SB 2464 which also protects buyers of used cars..

    Then consolidated Senate Bill (SB) 2464 was principally authored by Villar (SB 775) along with Sens. Aquilino Pimentel (SB 1812) and Miriam Defensor-Santiago (SB 2445).

    Stressing that a motor vehicle is a major economic investment, Villar filed Senate Bill 89 or the Lemon Law entitled, "An Act providing protection and remedies to buyers of new and used motor vehicles."

    (2) In case a non-conformity of the vehicle is found by the DTI, it shall rule in
    favor of the consumer and direct the manufacturer, distributor, authorized dealer or
    retailer to grant either of the following remedies to the consumer:

    (i) Replace the motor vehicle with a similar or comparable motor vehicle
    in terms of specifications and values, subject to availability; or

    (ii) Accept the return of the motor vehicle and pay the consumer the
    purchase price plus collateral charges.

    sigurado aabusuhin ng mga car buyers ang batas na yan

    at sigurado may panlaban diyan ang car dealers

    bibili sila ng lemon insurance and add the cost of insurance to the price of the cars hehe

    hindi naman basta-basta maabuso ng car buyers. for minor issues, covered na yan ng standard manufacturer warranty.

    for major issues, yan ang covered ng anti-lemon law.

    (n) "Non-conformity" refers to any defect or condition that substantially impairs the
    use, value or safety of a brand new motor vehicle which prevents it from conforming to the
    manufacturer's or distributor's standards or specifications, which cannot be repaired
    , but
    excluding conditions resulting from noncompliance by the consumer of his obligations
    under the warranty, modifications not authorized by the manufacturer or distributor,
    abuse or neglect, and damage due to accident or force majeure;
    the anti-lemon law actually gives a lot of chance for the manufactuter/dealer to fix the problem..

    initial remedy is four (4) repair attempts muna..

    even when you invoke the law, you must give one more chance to the manufacturer/dealer for one (1) final repair attempt

    SECTION 7. Availment of Lemon Law Rights. - Subsequent to the filing of the
    notice of availment referred to in the preceding section, the consumer shall bring the
    vehicle to the manufacturer, distributor, authorized dealer or retailer, from which the
    vehicle was purchased for a final attempt to address the consumer's complaints to his
    satisfaction.

    This law should encourage dealers to be more upfront with products they sell. Mas malaki ang lugi ng consumers kung walang Lemon Law, and it would be very difficult to abuse it ng nga consumers dahil burden of proof ay doon sa nagreklamo. Mas mag worry nga tayo sa mga magic tricks na gagawin ng dealers to circumvent the law. Sila ang may malalalim na bulsa to tie each case in court, not the consumer. So kung ako sa inyo, let's support this law dahil tayong consumers ang agrabyado kapag wala ito.
    Ang kailangan lang talaga sipagin mag formal complaint kapag may hindi tamang practices para may aksyon na magagawa ang kinauukulan.

    actually, that's the idea of the anti-lemon law. to make manufacturer/dealer realize that selling lemon cars would not be profitable to their business. no more lemons!

    I think foul ito at hindi papasa sa DTI. It's like wala ring lemon law.
