one of our guys from davao was stopped at a checkpoint and was ordered to open the hood. they checked the engine number against the one in the CR.

AFAIK, the police should have a search warrant for that. Lets wait for our fellow tsikoteer's reply.
nope. kung ano lang nakikita nila without opening any part of the car unless may search warrant sila.
It's called the Plane View Doctrine. They cant even ask you to open ur compartment. If they do that, may laban kna sa kanila...
bsta mga tsikoteers, pag pnagawa sainyo un, wag kyo papayag. tell them that theyre violating the plane view doctrine!!![]()
Di ba "plain view"?
May dalawang thread sa baba about checkpoint guidelines tsaka text 2920 for checkpoint abuses.
Don't know if they're still current.
correct me if m wrong
nope hindi pwede. They are limited to visual inspections. They can only ask you to open the trunk/hood or whatever if they find a reasonable cause to do so. Example, while conducting an ocular inspection, they find a tip of a rifle sa passenger seat. In that case, there will be a reasonable cause.
If ever they find evidence against you by forcing you to open the hood when there is no reasonable cause, then such evidence is not admissible in court for being a "fruit of a poisonous tree." This is your constitutional right against self-incrimination.
Pero of course, this would not apply kung sa mga malls. Kasi the bill of rights only applies between you and the State (such as the police in this case)
Wilcats: poligov? sa lasalle ka ba? sino prof mo? baka classmates pa tayo hehehe. By the way it's plain view doctrine. And it applies to searches without warrants or even if with a warrant but not included in the same. Pwede nila gawing evidence if while searching, they find something not related to the warrant but within their "plain view"

make sure that you say it in a nice and humble way.
kaya ako, pag may checkpoint, patay headlights, bukas dome light. just so they know na alam ko kung pano maghandle ng checkpoints.
