A close friend of mine got into a car accident this morning near Kalayaan C-5. Although she freely admitted that it was her fault (I was giving her advice the whole time through her cellphone), the cops at Orense Guadalupe still gave her a ticket and wrote down "Involved in accident" on the TVR and took her license. According to the officer, there is a new ordinance where you'd have to get clearance from the City of Makati before they give your license back.
Anyone here have a similar experience? I'm still wondering if it was right for them to take her license...that's really what I want to ask you guys.
I got involved in an accident last January and what the cop did was just list down my license number and other personal details, but no confiscation happened whatsoever. I don't know about your friends case, but mine was just very recent.
I am sorry about the accident of your friend. Alam ko di dapat i-confiscate unless the the Makati council just recently passed (not more than a month) the allegedly mentioned new ordinance.
Actually, proper procedure is to confiscate license for anyone involved in an accident. Kung nasusunod kasi yung rules, dapat point yun sa license mo because if you are frequently involved in accidents, they can conclude you are a potential road hazard.
The rules for LTO are very similar to those of US and EU, pero maraming hindi nai-implement, but if you look at a TVR closely, there is a checkbox for "involved in accident" meaning dapat talaga hinuhuli.
been involved in an accident once (sa dagupan pa so talagang kalayo naman). yung pulis dun want to confiscate my license until hindi kami nag kakasundo nung nabangga ko. what i did is to enter into an arrangement with the nabunggo na papagawa ko lahat ng damage and had it written sa police report and sa blotter para hindi ko na balikan yung license ko dun.
i think talagang kailangang i-confiscate yung license pero nakukuha sa areglo yan.
usually kapag nagkasundo na yung bumangga at nabangga sa presinto infront of the investigating police, hindi na kino-confiscate ang lisence. nagkakaroon nalang ng pirmahan regarding dun sa kasunduan with the police as witness.
