    Sa mga nakaka alam or may alam sa batas, ano po ang inyong opinion?

    May project sa amin na magkaroon ng automated gate sa entrance ng village. Homeowners Members who are in good standing (walang utang sa homeowners dues) are given for a minimal one time fee an e-pass to access the express entry lane. If in the future you become delinquent in your payments, the e-pass is automatically disabled.

    Delinquent members are told to use the visitors entrance and leave an ID or a drivers license.

    Since, the car owner is a residence of the village can he insist that he has the right of way and not leave an ID or his driver's license?

    Currently, some delinquent members simply pass by the residents' gate and not leave an ID.

    Maybe as a general question, can any homeowner, in any subdivision, insist on his right of way and not leave any ID at the gate?

    How much is the e-Pass?

    While most subdivisions require gate passes, if you're a homeowner who has land inside the subdivision, the other homeowners have no right, AFAIK to prevent you access to your land. I think you have the right to insist on your right of way.

    Hi Niky,

    One time fee of P350 for the epass. Hot issue ng iyan dito sa village namin and causing a lot of animosity. This will serve as the gate pass. OK sana kung bigyan lahat ng homeowners, delinquent in their homeowners due or not. Ang balita ko iyong walang utang lang ang bibigyan.

    A one time fee of P350 is a fairly good amount for village security...Plus, it gives you an automatic way of identifying homeowners with updated payment of dues.....

    Sa amin nga P75 per sticker/car for homeowners,- ayaw pang magbayad... :hysterical:

    75php lang ayaw pang magbayad.

    Sa mall nga ilang hours lang sila dun 45php ( SM mega ) na kaagad binabayad nila eh. Yan 75php lang, ayaw pa.

    to the topic starter, that is to be negotiated with the home owners association.. I am no lawyer but I do know that is the most logical way..

    You do not want to over ride protocols/ procedures as this will create confusion.

    and ok lang yung e pass as long as the home owners agrees to it and ok lang na mga walang dues lang meron nito - consider it as a incentive for being a good home owner.

    Please people be vigilant and think of other people not just your self.. May hiya lang. Respect y'all.

    Bro.,- hindi lang iyan, typical na 4 or more ang bilang ng mga sasakyan nila... At, karamihan ay less than 5 years ang mga ito... 2 lang ang garahe, at ang natira,- nakaparada sa kalye... Tapos, ayaw ngang magbayad ng P75 sticker per vehicle?!...

    Ganyan talaga yata ang ibang mga Pinoy,- hangga't makakagulang,- gagawin.... Puro mga free riders... Sa ibang bansa naman,- mababait at masunurin....

    Hehehe... Ang dami kasing mga homeowners na sobrang titigas ng ulo... Ayaw magbayad ng association dues even though they benefit from the security of the village they stay....

    Iyong iba ayaw bumili ng murang sticker ng subdivision.... Tapos, ang mga ito pa ang ngakngak ng ngakngak kapag may nakakasalisi.....Sasabihin pa si village guard,- "Hindi mo ba kilala ako?" (ayaw mag-iwan ng lisensiya)... Ang kapal ano?

    BTT: Yes, they have the right of way,- but they are just insolent free riders....
