    MANILA, Philippines (UPDATED) - An Italy-based company has complained that it never gave Globe Telecom Inc. the authority to use the "Tonino Lamborghini" brand for its mobile 4G broadband stick.

    In a statement quoting chief executive officer Tonino Lamborghini, the company maintained that the said broadband stick is "a counterfeited product."

    "Tonino Lamborghini s.r.l. has never manufactured or authorized anyone to manufacture such a product, which constitutes therefore a serious trademark infringement," Lamborghini said in the statement, which was posted in the Italy-based company's website and in several blogs.

    "Moreover the advertising campaign 'Feed your need for speed' featuring Marlon Stockinger, first Filipino to win a formula race in Europe, is deceitful and unlawful since it leads to a serious likelihood of confusion between two different and separate brands and businesses that is to say 'Tonino Lamborghini' and 'Automobili Lamborghini,'" he added.

    "Tonino Lamborghini s.r.l. shall take any legal action to protect the brand."

    Globe's Tonino Lamborghini Tattoo broadband stick features the Italy-based company's name and logo, and has racer Marlon Stockinger as an endorser.

    Tonino Lamborghini is known for its luxury watches. Automobili Lamborghini, on the other hand, is a car manufacturer.

    In a statement, Globe Telecom said it "obtained authorization to use the name and logo Tonino Lamborghini through an agreement with Primo Mobile, the master franchisor of mobile phone related products for the Italian brand Tonino Lamborghini."

    "Primo Mobile is a Singapore-based company that has a master license agreement with Tonino Lamborghini s.r.l. and is duly authorized to sub-license the use of the Tonino Lamborghini logo. The design of the Globe Tattoo Tonino Lamborghini 4G broadband stick was reviewed and approved by Primo Mobile," Globe Telecom said.

    Globe Telecom assured the public of its "strong adherence and commitment to the highest ethical standards in business and good corporate governance. The company will not engage in any activity that will mislead the public in the course of doing business and serving its customers."

    [SIZE=4]Globe Telecom accused of counterfeiting Italian trademark[/SIZE]

    TONINO LAMBORGHINI s.r.l has threatened to sue Globe Telecom, Inc. for using the Italian trademark on a line of broadband sticks promising speedy connections.

    The purveyor of sport, fashion and home accessories took issue with the use of the trademark to connote the image of a separate luxury vehicle brand as Globe Telecom campaigns featured it alongside a race car driver.

    The telco’s marketing campaign featuring Marlon Stockinger -- a race car driver that has won in a European circuit -- alongside the Tonino Lamborghini trademark “is deceitful and unlawful,” the Italian firm said, noting it was a “different and separate” business from Automobili Lamborghini.

    “Tonino Lamborghini s.r.l. shall take any legal action to protect the brand,” Gian Luca Filippi, chief executive officer, said in a statement dated Aug. 3.

    “[The firm] wishes to inform its customers that unauthorized people are currently trading online and through Globe [Telecom] stores a 4G Tattoo Tonino Lamborghini broadband stick which is a counterfeited product,” Mr. Filippi said.

    Globe Telecom’s broadband stick bears the same logo and the same brand name written in identical font. The product was launched only in June.

    The Italian firm said that it has “never manufactured or authorized anyone to manufacture” the product in question which it said carried a “serious trademark infringement.”

    Earlier this year, Tonino Lamborghini had issued a similar statement denying an agreement with beverage makers Blue Gold Beverages, Inc.

    and Epic Nutrition Canada to use the trademark on energy drinks.

    Sought for comment, Ma. Yolanda C. Crisanto, Globe Telecom’s head for corporate communications, said in a text message that the matter is only a “misunderstanding.”

    Globe Telecom’s Tattoo Tonino Lamborghini stick runs on its HSPA+ (Evolved High Speed Packet Access) network.

    The firm said that the broadband stick can deliver an internet speed of up to 10 mbps, and is available at a P2,199-plan monthly.

    Earnings of the Ayala-led telecommunication firm grew 9% to P5.5 billion during the first six months of the year from P5.06 billion in the same period last year.

    Shares of Globe Telecom closed 0.61% higher at P901.50 apiece yesterday. -- K.A. Martin

    how can Globe be so stupid?

    akala ko pa naman they paid Lamborghini. i mean for such a big company (Ayala company pa) they should know better

    like if you wanna put mickey mouse on your products you pay Disney

    yun pala they used the Lamborghini brand name and logo without permission. Globe is no different from China counterfeiters

    what were they thinking?

    And the ad very very misleading, they are trying to portray the AUTOMOBILI in their ads rather than the TONINO which are two different companies (mas sikat nga lang si AUTOMOBILI ) yun pala yung TONINO ang nakalagay sa stick.

    when that idea was proposed by their marketing people/ad agency, inapprove ng mga decisionmakers ng Globe without thinking if it was legal or not?

    In a press release issued by Tonino Lamborghini s.r.l., the Italian company claimed that Globe Telecom is not authorized to use “TONINO LAMBORGHINI” on its Tattoo internet sticks. The telecom giant has already issued an official statement in reply to Tonino Lamborghini’s allegations.

    In its official statement, Globe states that it obtained a license to use the trademark “TONINO LAMBORGHINI” from Primo Mobile, a Singapore-based company that is allegedly a master franchisor of mobile phone related products of the Italian brand. Primo Mobile is said to be duly authorized to sub-license the Tonino Lamborghini logo.

    Reproduced hereunder is the statement posted on the Tumbler page for Globe Tattoo:

    "Globe Telecom obtained authorization to use the name and logo Tonino Lamborghini through an agreement with Primo Mobile, the master franchisor of mobile phone related products for the Italian brand Tonino Lamborghini. PrimoMobileis a Singapore-based company that has a master license agreement with Tonino Lamborghini s.r.l. and is duly authorized to sub-license the use of the Lamborghini logo.     From the press release of the Italian company, it appears that it has not authorized Primo Mobile to sub-license. Otherwise, it would have checked with Primo Mobile if Globe is a sub-licensee before making public its position on the matter. Then again, all we can do here is speculate. If what Globe Telecom claims is true, this ultimately becomes a matter between Primo Mobile and Tonino Lamborghini s.r.l.

    SingTel (Singapore Telecommunications) owns 47% of Globe Telecom, while Ayala Corp holds 32% .. the rest is in public hands.

    Typically naman in these kinds of cases, when you ask about something, you're directed to the regional office or the sub-office handling all such business.

    I can see it now:

    "Tonino Lamborghini HQ? Yes, I am from the Phlippines representing Globe Telecoms, we are interested in pursuing an agreement with you regarding..."

    "Philippines? Telecom? Hold on, I will give you the number of Primo Mobile in Singapore. All business in that region HAS to be conducted there, and they happen to handle all telecom products."

    The fact that the company also denied links to a beverage company tells me this is more of a problem of corporate communication between Tonino Lamborghini and its associates than a problem with Globe.

    I'm still not buying a Lamborghini stick. Not until they fix the crap 3G signal in our area, anyway.
