There's so much fuss about Erap running again for President in 2010. Legally, pwede pa ba siya?
Sa mga abugado at constitutional experts natin dito, ano'ng opinyon niyo?

He only served half-a-term in office. So he can run one-and-a-half more times.
What other problem would there be? Heck, even jailed people can run for the senate or congress, what's to prevent a pardoned man?
Ang pagbalik ng comeback...
No, he can't. Our Constitution expressly states that the President shall not be eligible for re-election and that voluntary renunciation of the office for any length of time shall not be considered as an interruption of the continuity of the service for the term for which he was elected.
GMA was the exception considering that when she assumed the presidency after Erap, she did not serve for more than 4 years of the remaining term of her predecessor.
Erap will probably argue that he did not voluntarily leave office and that he was forcibly removed which makes him eligible to run, but this was already settled by the Supreme Court in the case of Joseph Estrada vs. Aniano Desierto and Gloria Macapagal-Arroyo, GR No. 146738, March 2, 2001 wherein the Court ruled that Estrada had, in fact, resigned. The SC said that while Estrada did not write any resignation letter, prior contemporaneous acts, coupled with the circumstances surrounding his departure of Malacaņang and statements made beforehand was interpreted to be his act of resignation from office.

I saw it from the news yesterday. Nabanggit nga ni M. Santiago na tatakbo daw ulti si Erap.Either of the billionaires daw ang mananalo: Villar, Roxas at Erap!
![]()
Sabi daw ni Erap initially na ayaw na niya sa politics and di siya tatakbo, but then again ganyan rin ang sinabi ni GMA before 2003 ended.
With the way Erap is attracting crowds on his visits in Tondo and Navotas, medyo tagilid ang kalaban pag tumakbo ulit ito. Baka manalo ulit siya..........![]()
Ganun nga rin ang pagkakaintindi ko na once you get elected for president, whether matapos mo o hindi yung term mo for whatever reason e di ka na pwedeng tumakbo uli.
He can't run anymore, e-ika-ika na nga syang lumakad parang penguin...
seriously, the SC stated that erap vacated the presidency/resigned so therefore hindi na pwede kasi one term lang allowed sa consti but in a twist
of faith who knows baka pwede sya uli at posibling manalo dahil marami parin
ang mga politically illetirate dyan sa pinas at ito'y sinasamantala ng mga politicians...kung magkakataon, sasaya ang mga dollar earners dahil aabot sa
more than a hundred pesos to a dollarsige erap takbo na...iboboto na kita
tagal naman...
Dapat nga hindi na pwedeng tumakbo, But...............
A week back Lawyers Harry Roque (the big burly guy w/ a receding hairline) of the UP Law Public Interest Center and Erap defender Rufus Rodriguez were seen on ANC laying the foundation for what could be their legal argument to justify Erap's running for office.
Per their arguments, they qualified that Erap has regained his civil-political rights. Then they further cite that indeed the Constitution clearly disallows "Re-election", however, if Erap casts his lot in 2010, he is not technically running for re-election since he is not the incumbent president. Roque further opines that a re-election refers to consecutive terms of office, which cannot be applied in Erap's case.
They may or may not be right, but in a country like ours everything can happen. The legal profession has time and again twisted, turned and made an acrobat out of the English language in presenting their oral arguments. So who knows?
In the meantime, Erap's comeback in 2010 is a sure thing, Trillanes' harebrained power grab failed because the throngs of masa he vainly waited for were busy lining the streets by the thousands in Payatas to welcome Erap and Binay in their early campaigning last Thursday.
For someone who was convicted of plunder, he should be barred from running for any public office.
Plunder is a grave crime against the State and Its People.
