"The court sentenced Garcia, the military's former comptroller, to dishonorable dismissal, forfeiture of benefits, and hard labor for two years."

    source: http://news.inq7.net/breaking/index....story_id=58535

wala bang criminal case na naka-file sa courts other than military? kasi plunder yun di ba, dapat minimum life imprisonment to death ang penalty.

Report: Military court finds former AFP comtroller guilty
    12/02 3:13:47 PM

A military court Friday has found retired Major General Carlos Garcia, the former finance officer of the Armed Forces of the Philippines (AFP), guilty of graft and corruption, according to media reports.

Garcia had been found guilty after the prosecution panel argued that they have proven beyond reasonable doubt that Garcia violated Article of War 96 or Conduct Unbecoming of An Officer and a Gentleman and Article of War 97 or Conduct Prejudicial to Good Order and Military Discipline.

The charges stemmed from Garcia's misrepresentation of his statements of assets and liabilities for 2002 and 2003 and for the possession of a United States "green card" while serving as a general of the military.

Though Garcia had been retired from the service, he now faces imprisonment and forfeiture of his benefits as a former military officer.

Garcia is also facing a 303-million pesos plunder charge and four counts of perjury before the Sandiganbayan.

The verdict is meaningless. 2 years hard labor? How many will believe that he'll actually be made to do that? I think the court martial proceedings were done for show. There were too many generals to protect and Garcia has the dirt on all of them being the former comptroller of the AFP. Hawak nya pera.

The dishonorable discharge IMHO is moot and academic considering that he has attained retirable age from the AFP. Forfeiture of benefits? Hello?

    Well, consider these things:

    1. The results of the court martial, while persuasive, is not conclusive on the civil courts. Remember, it involves violation of the code of conduct of military personnel and not the violation of law. Garcia can still be found innocent in the civil courts.

    2. You're right. A lot of his assets have been frozen. But, keep in mind, he's probably been smuggling money out of the country for years. Meaning, that's just the tip of the iceberg. I have very strong suspicions that he has money stashes everywhere and abroad.
