    Gloria prepares for martial rule; staged terror attacks set

    EO 467 CALLS ON AFP, PNP TO QUELL POLITICAL DISSENT UNDER ?NATIONAL EMERGENCY?


    The imposition of martial law is just around the Malaca�� corner, with President Arroyo having signed a new Executive Order (EO), numbered 467, to be released after Congress goes on recess, a Palace source told the Tribune yesterday.

    The issuance of the EO will reportedly be preceded by bombings in Metro Manila, which will then be packaged by the Palace as a grievous terror attack, to justify her declaration of a national emergency, without Congress in session to question her actions.

    It was said for the bombings that will be staged, the private army of a Mindanao mayor will be tapped by Mrs. Arroyo and her generals, with the military and police brass supplying the ?right? kind of explosives usually utilized by the Jemaah Islamiyah, to give the staged terrorist attack credence.

    International support for Mrs. Arroyo's veiled martial law will then be extreme for the President which is what she intends to have.

    Under the Charter, private armies are banned, but this Mindanao mayor's private army is said to have the support of Mrs. Arroyo and her generals, which is the reason human rights violations, deaths and salvagings in his jurisdiction have not abated and continues to this day.

    Under the Constitution, in times of war and national emergency, the Congress may, by law, authorize the President, for a limited period and subject to restrictions, to exercise power necessary and proper to carry out a declared national policy. Unless sooner withdrawn by resolution of the Congress, such powers shall cease upon the next adjournment.

    It was, however, pointed out that once Congress goes on recess, to convene and have a quorum may prove difficult within a limited period of 48 hours. And as the 'staged' terror bomb attacks will immediately constitute a ?national emergency,? there may be no opposition from Congress, the source intimated.

    The insider said that ?everything has been thought out? by the Persident's 'legal team? which includes defense secretary Avelino ?Nonong? Cruz, Justice Secretary Raul Gonzales and legal counsel Merceditas Gutierrez, among others.

    The source said the President's EO will not be an outright declaration of a state of martial law, but for all intents and purposes, it will be a martial rule, with the military and police empowered, under a declared national emergency, to quell political dissent and lawlessness.

    EO 467 reiterates her commander in chief powers under Article Vll, Section 18 of the Constitution, ordering the Armed Forces to prevent or suppress lawless violence, invasion or rebellion.

    ?All political dissent will be met with military and police force. Political leaders will be rounded up and arrested without warrant and all vital business will be taken over by Malacanang,? the source said.

    It was also intimated that all the moves being made by Mrs. Arroyo are a prelude to the issuance of EO 467.

    The Calibrated Preemptive Response (CPR) policy being implemented by the Philippine National Police (PNP), it was said, was the start, followed by the military's latest 'shoot to kill' orders issued the other day.

    ?President GMA (Mrs. Arroyo's initials) has been, in a way, telegraphing her punches already,' the source noted, using the espionage case against an American Federal Bureau of Immigration agent Leandro Aragoncillo and Filipino police officer Michael Ray Aquino's as a starting point, to 'set the stage' in rounding up her political foes.

    The other day, she linked her political foes to the espionage charges, calling them ?robbers? and ?power grabbers? while her Secretary of Justice Raul Gonzales followed this up and identified the local political figures as detained President Joseph Estrada and Sen. Panfilo Lacson, with an announcement that they could be charged with espionage and sedition while searching for the alleged ?money trail.?

    Already, Mrs. Arroyo's police and military generals have been alerted to her plans and have reportedly given their support for it.

    ?The 'shoot to kill' order of the AFP (Armed Forces of the Philippines) against recruiters of the military soldiers is part of the plan,? the Palace insider said, adding that even the Calibrated Preemptive Response against the anti-GMA demonstrators is part of the martial law scenario.

    Following up on his earlier shoot to kill recruiters order, Army chief Lt. Gen. Hermogenes Esperon on Saturday said the Philippine Army will be using Calibrated Response (CR) which would be the counterpart of the PNP's CPR to block any destabilization moves against the Arroyo government.

    The Military's CR calls for proportionate force that will be used against any person or group that would embark in a campaign luring members of the Philippine Army into participating in any destabilization effort against the government.

    Esperon said that military's action is in response to information they received that some groups are recruiting army soldiers into joining destabilization efforts against the government.

    ?Aside from the recruitment efforts, the organization is also the target of sustained disinformation campaigns intended to sow divisiveness and challenge the solidarity and unity of the organization? Esperon said.

    On the reported issuance of ?shoot to kill orders,? the Army chief clarified that the Army, based on existing standard operating procedures (SOP), will intensify its monitoring efforts against any and all destabilization efforts.

    He said it is normal for the military to invite identified individuals for questioning or arrest them if there is evidence beyond reasonable doubt that there are acts of recruitment or even bribery to commit acts against the government, or when there are overt acts of violence against our troops; and when they violently resist questioning or arrest, thus our calibrated response or proportionate forces shall be applied.

    ?All efforts to sow divisiveness and lure the soldiers into any acts of adventurism and any destabilization efforts will fail. The Philippine Army will meet them head on. We remain to be a strong, solid, and united organization,? Esperon added.

    He added that ?if they (destabilizers) insist then the Army will give them what they have been asking for,? he said .

    A source from the Young Officers Union (YOUng) said that the AFP's CR which the military is now implementing is a delayed reaction, as the recruitment stage has been over. ?Who would follow these orders if the recruitment stage is over even before they (military brass) came up with the shoot to kill orders and the calibrated response?? the source asked, adding that the groups of young officers are ready anytime and ?it's now the question of timing, the recruitment is over.?

    Meanwhile, Armed Forces of the Philippines (AFP) Public Information Office chief Lt. Col. Buenaventura Pascual yesterday said that the military was misquoted and misinterpreted when Esperon and Major general Efren Orbon, chief of the Tanay-Rizal based Army, 2nd Infantry Division (ID) there was a shoot to kill order against any destabilizers.

    In a text message, Pascual relayed to the media that Esperon was misquoted when he clarified the statement of General Orbon in connection with the shoot to kill order.

    ?Many newspapers today quoted CG2ID General Orbon as having ordered the monitoring, arrest and shooting destabilizers. Some reported it as a shoot to kill order. It was also added that I have given similar orders to all army commanders. I did clarify the statement of Orbon but for both of us it was a case of being misquoted and misinterpreted or of intentional slanted news reporting, trade hazards.

    This was also denied by AFP chief of staff Gen. Generoso Senga, who in a radio interview yesterday said the AFP will strictly apply the rules of engagement in dealing with the destabilizers from the military organization.

    ?We will still abide by the policy of strictly observing the rules of engagement,? Senga said.

    In military parlance, the rules of engagement refer to the counter action of law enforcement personnel to shoot back only if fired upon by an aggressor.

    Esperon said that firstly he ordered military commanders to monitor and report the identities and movement of suspected destabilizers among the troops.

    Second, he emphasized that military personnel suspected to be involved in the recruitment of soldiers to join destabilization efforts and other attempts to overthrow the government will be invited for questioning when they establish prima facie or strong evidence against them.

    Soldiers who will be found bribing fellow soldiers to commit acts against the government will also be summoned by the military leadership, he added.

    And lastly, the Army chief also emphasized that when the suspected coup plotters ?violently resist? the questioning or the arrest procedures, the military leadership will apply the calibrated preemptive response or the proportionate force if needed.

    Esperon visited the 2nd Infantry Division headquarters in Camp Capinpin in Tanay, Rizal the other day to check the morale of the troops in the field amid the political crisis now hounding the Arroyo Administration.
