Padaca named Comelec commissioner | Inquirer News

A welcome news IMO given the recent political activities headlining the news.

Interesting. Goodluck to her as she's one of those who gave hope when she beat that dynasty in her province.

What happened with the cases her political rivals filed?

La na rin ata balita don. Harrassment lang naman yun. Interesting would be how easy or tough her session with the CA will be.

    Baka ma-Robredo din.

Political families like the one Padaca went against will do anything to ensure their continuity in power...which is why we needed that Anti-Dynasty Law like, two decades ago.

At the very least, the rule of law should be that children, wives and first cousins cannot run for the same position as a current politician in the next election.

It's incredible that political dynasties have been banned by the Constitution, and yet here, over twenty years later, we still don't have an implementing law.

    Ang pagbalik ng comeback...

Padaca's appointment no maTter how good intentioned imo is illegal. Constitution prohibits appointing someone who ran in the immediately preceeding election.

Appointments are not allowed for one year succeeding the election. We've gone beyond that. That's why Mar and co. already got their postings.

The weird thing is... if there is a case... and if indeed the NGO involved did not liquidate the money, there IS a case... then it should be heard through.

    Yun lang.

I think sa mga sagot ni Padaca sa media.. hindi naman daw ibinulsa ang pera.. may receipts naman daw na natanggap ng mga beneficiaries... not sure kung yung point ng graft is dapat ba ay may bidding....

My surname is not dy. i am just stating what i read from the constitution. No matter how good intentioned the appointment may be it still is a violation of the constitution. And may i add that i am also for padaca. The provision for the comelec does not have a 1 year limit. All it says is not a candidate in the immediate preceding election.

Section 1. (1) There shall be a Commission on Elections composed of a Chairman and six Commissioners who shall be natural-born citizens of the Philippines and, at the time of their appointment, at least thirty-five years of age, holders of a college degree, and must not have been candidates for any elective positions in the immediately preceding elections. However, a majority thereof, including the Chairman, shall be members of the Philippine Bar who have been engaged in the practice of law for at least ten years

No stopping Padaca from sitting in Comelec

No stopping Padaca from sitting in Comelec—Palace
There’s nothing in the law, not even a graft case, to prevent Grace Padaca from sitting as a commissioner in the Commission of Elections (Comelec), Malacañang said Wednesday.

The former Isabela governor can perform the job “competently and without fear or favor” even if she’s fighting a graft case before the Sandiganbayan antigraft court, said presidential spokesperson Edwin Lacierda.

Lacierda said he was positive that Padaca would not be assigned as Comelec commissioner to a region where she would be handling cases involving her provincemates.

President Benigno Aquino has appointed Padaca to replace information technology expert Augusto Lagman who failed to get confirmation from the congressional Commission on Appointments.

Padaca, 49, is facing arrest over graft charges which she said were politically motivated. She has refused to post bail in protest at the way the case was decided against her. But with her new appointment, Padaca said she may now need to post bail.

Padaca is accused of awarding to a nongovernment organization in 2006, while still Isabela governor, a contract to manage a P25-million credit facility for rice farmers, without public bidding. She has argued that bidding was not required, and the government was not adversely affected by the deal.

Lacierda said that contrary to some observations, Padaca’s candidacy in the May 2010 gubernatorial race did not bar her from sitting in the Comelec.

The Constitution states that the chair and six commissioners of the poll body must not have been candidates for any elective position in the “immediately preceding elections,” among other requirements.

According to Lacierda, the immediately preceding elections were the October 2011 barangay polls, not the May 2010 elections, hence Padaca could not be disqualified from the post.

“She was not a candidate for the barangay elections. The Constitution does not say it should be a national election. So where the law does not distinguish, we should not distinguish,” he said.

He said Padaca was very much qualified for the position.

“She’s a woman of integrity. We believe she can apply the election laws in an objective manner and she will advance also the cause and reforms in the Comelec,” he said.

kakampi: Padaca. May pa yung arrest warrant walang humuhuli. kung dpa na appoint sa comelec dpa huhulihin. cant blame the cops baka mapag initan pero the thing is ang pag initan yung sandiganbayan na naglabas mg warrant. now sya pa nag pyansa. so how can padaca work independently kung may utang na loob?
