March 3rd, 2008 01:31 AM #1Meron akong gustong bilhin na property. Ang problema, nakapangalan yung property sa mga anak, 3 sila pero nasa abroad ang 1 anak. Sabi ng parents, i-forge nalang daw nila ang signature ng anak nila na wala dito. Sa kanilang magasawa talaga yung property, pero ipinangalan lang nila sa mga anak. Kakilala ko ang pamilya nila. Ano bang magiging problema ko sa ganitong situation?

wala naman problema dito. unless MAGHABOL YUNG ISANG ANAK NA YUN. then, malaking problema yan.

pagawa sila sa anak nila na nasa abroad ng SPA na pwede nila i transact ang land and sile pipirma. or pa send nila ang deed of sale abroad via express mail pa sign sa isang anak then pabalik dito pa sign sa iba.
walang kilala kilala pag pera na ang pinaguusapan. mahirap na baka ma technical ka pa sa court in the future pag magdemandahan na.

wag ka papayag na forged yung signature ng anak. pumayag man sya verbally pero dapat mag execute sya ng SPA.
if from abroad, dapat authenticated ng phil embassy yung SPA document to be valid.. di yata pwede yung isend lang yung document abroad para mapirmahan lang, kasi dapat nakaharap sa notary lawyer dito lahat ng pipirma sa deed of sale..

You should do a little more "due diligence" work for the property you intend to buy because you'll have a hard time running after the seller once you part with your hard earned money. Ask to talk to the co-owner who is based abroad to confirm what his/her parents will be doing (namely selling the property to you).
Follow Elroi's advice too.
It's also advisable for you to put some recourse against the Sellers in your Deed of Absolute Sale. Pa-tulong ka nalang sa kilala mong lawyer.
