Kami nun dinaan muna namin sa barangay, Meeting muna with the tenant, make arrangements and compromise para naka record and may witness.
Damn, just checked the contract, walang nakalagay about failure to pay rent on time.

Baranggay mo na yan kahit walang time constraints sa contract para meron na record.
Send a demand letter. Preferably from a lawyer or law office. Thats usually enough to make them pay. If after the time specified in the demand letter lapses, and they still refuse to pay, you have legal grounds to evict. I'm not sure but I belive eviction can be done with the presence of barangay officials. Best to have the barangay cap or at least tanods present when evicting. At the very least you have witnesses, they will also prevent "gulo"
Try to video tape the eviction so if they become violent, you have evidence.
Eviction is never easy. Be prepared to just let them go and loose the 1 month rent. They may even ask you to give them time to look for a new place.

san ba yan, sa quezon city? kung sa qc, 1st question nyan sa barangay ay kung may permit ka sa barangay or city hall na magpa-rent ng property. commercial man or residential need mo ng permit, for tax purposes. pag wala hindi ka nila tutulungan, di nila i-schedule ang hearing nyo ng tenant sa lupon.
ganyan din ermats ko may pinapaupahan siya na 1 commercial. may contract, stated sa contract na pwede paalisin after 2 notices. pero di maisampa ni ermats sa barangay kasi nung nagpunta ako yun una ask nila, dapat daw pag sign pa lang ng contract of lease pinasok na sa barangay ang copy para nakakuha ng permit. pag wala daw, on your own ka. at least naman yung tenant ni ermats e magbabayad na, sa wakas.
ganito din nangyari samin before, di na nagbabayad ng rent, pati kuryente tubig, hindi din binabayaran. pinabarangay namin, me hearing na pinadala barangay, hindi pa din pumunta, 3rd notice at di pa din pumunta, barangay na nagpaalis, ayun umalis din. grabe perwisyo pag ganito. hope mapaalis mo na yan kahit makabayad kasi mangyayari at mangyayari ulit yan, sakit sa ulo yan.
Nagbayad na nung sat ng 2 months. May utang pa nyan 1 month. Sigurado hindi rin makakabayad within the month, so next month 2 months na naman ang utang nya. hayy.

Style yan talaga Boybi. Yung mga mag-update ng payments just enough to keep them from being evicted but overall they're not up to date on the full payments and deposit. Keep a close eye also on the condition of the unit they're renting as you won't have a deposit to fall back on if there are any needed repairs or expenditures.

Before ang worst experience namin is hindi nakabayad yung tenant ng 1 year. Yun na ata ang pinaka walang hiya na tao na nakilala ko. Mabait magulang ko masyado diplomatic kaya umabot ng 1 year, since anak lang naman ako and parents ko ang nagdedesisyon wala ako magawa.
Ang malala pa, napaalis nga namin kaso nanira sila dun sa unit nila, they even planned to burn the house down. Shinort circuit nila yung electrical connection sa bahay. Thankfully nakapatay yung genereal switch nung ginawa nila yun. Pag alis nila kumuha muna kami electrician to check baka nga may ginawang kalokohan at ayun meron nga.
mahirap yan, for sure mauulit yan... dapat next time pag di nakabayad paalisin na... baka sa susunod di lang 2 o 3 months yan...
