We were along meralco avenue coming from shaw going to metrowalk. When we reached the flyover area,we were surprised by a bright headlight that suddenly flashed from nowhere. When we recovered our vision we saw a motorcycle with two riders who are not wearing any helmets coming towards us blatantly counterflowing..o di ba ugaling skwakwa?

fyi, these bad riders are not out to ruin your day, or at least not out on the road to try to ruin your day.
people on the road are motorists doing the same thing as you and me but with different reasons. ako rin naman whenever I'm on the road on my scooter marami akong naeengkwentro na sira ulo, ogag, tang* na motorist but ano magagawa ko? the most that I can do is to be aware that they are there and be weary of their presence-- dagdag points for being a defensive motorist.
paranoia naman na kung iisiping nandyan sila sa daan with the sole purpose to ruin your day

there is no such law that states just because a vehicle is smaller, it means the bigger vehicle is liable. sure, meron nga tayong tinatawag na "value of life" priority but I am yet to encounter a law that automatically relieves a person of liability just because he/she uses a smaller vehicle.
this is under the premise that the other motorist does not have the right of way.
simple lang naman eh.. kasalanan nya dahil sa bad judgment call so liable siya. kung mabanga ka nya (if ever) dahil sa bad judgment, hindi mo kasalanan.

yesterday nasa pasay ako sa world trade. ayun.. mga green boys todo counterflow na naka-motor na walang helmet pathere is a helmet law in effect in metro manila pero ang numero unong violator ay ang mga pulis (and their counterparts LEO).

kaya in any collision and you know you are not at fault, best to pull out your cellphone and immediately take photos of the scene, bago magkaroon ng chance makapag-ayos ng pwesto ang kabilang panig.
I'm just saying there is no legal precedent for the idea that whoever drives a small vehicle is automatically faultless. wag matakot kapag sinumbat ng sinoman ang ganyan na rason.
it happened to my brother. nabanga siya ng MASMALIIT na scooter (yamaha dio, 50 cc, no plate pa) while naka-150 scoot ang kapatid ko. sagot raw ng kapatid ko ang damages and pagamot kasi masmalaki ang gamit nyayung nakabanga nagprapraktis magscooter sa kalsada sa harap ng bahay nila, going round and round in circles kaya nabanga ang kapatid ko.. walang lisensya tapos sasabihin kasalanan ng kapatid ko.

Unfortunately, that point of view isn't held by majority of traffic cops and enforcers. Based on my experiences and those of the people I know, they seem to interpret a specific clause in traffic law, to which I remember roughly as something sounding like the "four-wheeled vehicle must, to his utmost capacity, avoid to have the accident", into four-wheeled vehicle is always at fault.. (somebody correct me if I'm wrong)
In other words, for some mind-boggling reason, they interpret it in such a way that the final burden/chance to avoid the accident is always up to the car, never the other non-car party, no matter what the circumstances and/or who's in the right or not.
"Motorsiklo yan...talo ka na diyan." (Familiar phrase, anyone?)
And moroncyclists (and some stupid pedestrians) on the road know and abuse this fact, which is part of the reason why there's this stigma of them among car drivers and the reason why some of them want "protection" from these hoodlums.
PS.
Of course, aggrieved car drivers can get other ammunition to fight for his case, if he finds any, such as lack of license on the other party, etc. But if it were a level playing field when it comes to government requirements....Last edited by jave; March 30th, 2011 at 10:44 AM.
