    Dear Sir:

    Good day to you.

    I wrote this letter to convey my protest and to shed light over my alleged traffic violation yesterday March 18, 2003 approaching Magallanes Flyover at EDSA around 7:45 pm. My argument is based on the following points.



    SWERVING causing near accident and ignoring streetsigns- Before entering the clover leaf intersection at Magallanes, there is a designated lane for taxis, buses and private vehicles separated by metal poles and wires. I believe there is a good reason for MMDA to put this system into place but sir, please do hear my argument. I was well within the lane towards Alabang. Driving defensively, I was forced onto the leftmost side lane towards Pasay by a TRITRAN bus which SWERVED from the yellow lane. I had no other recourse but to steer to my left or else the bus will hit me. I did not want to hinder traffic so I pushed ahead slowly and waited CAUTIOUSLY to merge with the right lane going to Alabang. By this time, I was nearing the islands separating both lanes. I was flashing my turn right signal since I was forcibly caused to swerve by the bus but by the time I was at the right lane, MMDA enforcers were flagging me to stop



    The enforcers were polite and informed me of my violation. By that that time, It was at the highest point wherein I knew these people are professionals. I gave him my license immediately after he asked for it but at the same time explaining the reason of my alleged "dangerous swerve" I was dumbfounded by this violation, how can I be causing a near accident when I did not turn right abruptly and was using my flasher? I joined the lane when it was clear and did not force any vehicle to give way. He did not listen to me and just proceeded to filling up the TVR. I asked if I could just be pardoned since It was not my fault and if I could protest, he said that I should just go to the MMDA office to file it. I did not argue anymore and just asked for the good officer to give me the TVR. To my dismay, he did not even help me join the flow of vehicles going on Magallanes on-ramp. Since I was again on the side of the EDSA as not to obstruct traffic, I must again swerve to the right. My respect for them was now even lower than before. How could they not at least help me join the throngs of vehicles? Merging right is now more hazardous since if I moved forward, I will hit the island marker. My maneuver then was to be more abrupt and dangerous but alas, there was no help. Do the MMDA enforcers know how to drive? I'm not belittling them nor disparaging them. I believe that they are doing a very difficult job and admire them for it. But I do think, that these incidences need at least some common sense, how could they just leave my vehicle and me in a more dangerous situation than the original cause of apprehension? If their main interest is public safety, they could have at least gave assistance. This now fuels the general belief that MMDA enforcers are more interested on getting "a kill" than improving traffic and promoting public safety.

    Sir, I do hope that you do not disregard my letter and dismiss me as another angry motorist. Like any responsible citizen, who doesn't want an orderly traffic situation and then wish that someday, there would not be a need for traffic enforces sweating on the road, endangering their health and their lives. But, until that day comes, this is my humble contribution on the reality and a vivid picture of an incident on the road. How easy for me to just pay the fine, but I will not pay for it without having my side heard. I think this is the only way I could have my side heard and be noticed

    For the thousands of concern that you have to confront each and everyday as MMDA chairman, I do hope this letter gains your attention and concern.

    Parang kagagaling lang namin ni wiretap_md sa MMDA head office last Monday.

    In fairness, the MMDA head office does not seem like your typical riot-in-the-jungle government office. We were accomodated immediately and we conducted our business without hassle. Unfortunately, matagal ang processing ng papers namin kaya next month na ang balik namin.

    parang hindi naman si bayani mismo ang sumagot, napaka-impersonal. nothing in his reply is about the incident. puro tungkol lang sa kung paano mag-protest. wala lang.

    you're right on that!

    i also wrote an e-mail to the mmda chairman sometime last november 2003, and the answer is almost similar to jason's.

    anyway, 80% of contested traffic violation wins. yun nga lang, hassle. Kasi you have to attend the hearing, which sometimes, scheduled a month apart.

    if you're that "ma-prinsipyo" type of a guy, go ahead and contest the violation.

    believe me, you'll win. I've done it 3 times already.

    kalokohan yan swerving violation na yan. when you change lanes, can you call that swerving? when you avoid a bus like jason71000 would you call that swerving? applicable lang yan sa high speed traffic as in 100kph and above. Pag nanalo ka sa contested violation anong mangyayari sa a "arresting" officer. Sana may appropriate penalty din sila, kung mali talaga sila.

    kapag di mo kabisado dyan sa magallanes ramp, talagang mahuhuli ka ng swerving, karamihan dyan tinatakbuhan nila... di naman sila hinahabol... nakikita ko sila dahil madalas tuwing weekend dinadaanan ko yan pauwi. mga apat sila kung minsan yan, 2 sa gitna at 2 sa rightmost.

    isa lang talaga ang lane nyan... yung tabi ng taxi lane.... kaya malayo pa lang pumila ka na... ingat na lang sa susunod.

    I work with a contact center "programme" which has a similar feature or department called the "Office of the President". Unfortunately similar to that situation the President only reads and hears filtered complaints which are checked by a team of contact representatives. The Office of the President even has a Manager to look into escalated situations.

    Sad to say your lengthy and well written letter may have just fell into the amateurish hands of someone who didn't even bother to grammar check their work.

    PS: isinampa is not equal to slapped :freak:

    usually, hourly ang pag-set nila ng hearing. the actual hearing would last 20-30 minutes only (if the arresting officer is present)

    frt,
    2 no shows = automatic abswelto. the downside is you have to wait another 4 weeks in between two hearings.

    afrasay,
    pag nanalo ka sa contested violation, the only penalty for the arresting officer is wala syang tatanggaping porsyento dun sa violation. PERO, pwede mo syang ireklamo sa administration office na katabi nung office ng Adjudication Board.

    Lastly, if you're going to contest the violation, it would help to take pictures of the incident/ place of incidence and attach it to your complaint.

    Sa susunod, kwento ko sa inyo yung nangyari sa kin. Entering a 1-way street violation.

    well i guess the letter is indeed a template and i believe it was right for him to do that. if the mmda chairman would have to address all the traffic complaints personally, he wouldn't have time for anything else, that's how bureaucracy works

    I believe hindi pa rin nila ibigay ang license mo kun meron kang sinampang kaso...what you would be doing is have it stamped for "extension"....so temporay license mo yung ticket....until matapos ang kaso.

    dahil dyan nawala ang prinsipyo ko....i paid my penalty....

    Since wala pa sa mood mag kuwento si sir Bogart (busy pa siguro sa pagtayo ng cellsite sa JB) ako muna. 2,000 php + 3 mos suspension ng license ang multa ng entering a one way street. Sa likod ng Capitol Medical Center one night mga 1999 siguro yun nag short cut ako kasi traffic sa Quezon Ave. Aba may MMDA mobile car with 4 officers nag-aabang, one way na pala yun street na yun. And to think that I'm coming from a two way street. May nauna na AUV sa akin huli din. Tapos umikot ako after getting the TVR and surrendering my license. Wala naman one way sign sa corner. Binalikan ko ang mga ungas (pardon mr. Prez). Mayrun daw sign. ANAK NG .... nasa left side pala ng street at improvised sign lang. Pagbalik ko sa mag hinyupak na MMDA peeps wala na sila. Lipad ang 1,000 php ko, why 1,000? Dahil pinadukot ko na lang.
